Nayak is a senior advisor at the Department of Labor and served as a Deputy Assistant Secretary of Labor for Policy during the Obama administration. He also worked at the National Employment Law Project as Deputy Executive Director.

Nomination status: Nayak was confirmed by the Senate on November 3, 2021, by a vote of 52-45.
