DOL Nominee: David Weil

Nominated to be the Administrator of the Department of Labor’s Wage and Hour Division
Nomination announced: June 3, 2021

David Weil is the dean of the Heller School of Social Policy and Management at Brandeis University and previously served as the Administrator of the Wage and Hour Division during the Obama administration; the same post for which he is again nominated.  Weil is the author of “The Fissured Workplace”, which is views the gig economy and franchising business models as being harmful to workers.  During his previous stint at the Wage and Hour Division, Weil led the 2016 overtime rulemaking that was subsequently blocked by a federal court and created a new joint employer standard under the Fair Labor Standards Act that was repealed by Secretary of Labor Alex Acosta.

The Wall Street Journal described David Weil as “a life-long, left-wing academic with labor-union sympathies, no private-sector experience or legal training, and limited management experience. His most notable paper, commissioned by the Bush-era Wage and Hour Division, targets retail, fast-food services and other industries as enforcement priorities. (These industries are also union targets. Coincidence?)”

Nomination Status: The Senate Health, Education, Labor, and Pensions Committee attempted to advance the nomination of David Weil on Tuesday, August 3, 2021.  The vote ended in a 11-11 tie. Since the committee failed to advance the nomination, the full Senate must vote to recall Weil’s nomination before the Senate majority can further pursue Weil’s confirmation.
