MICHIGAN: Independent Contractor Restrictions, New Wage Mandates Advance in Senate Proposal
May 18, 2025 // Senate Bills 6 and 7 would reshape employment laws in Michigan by adding problematic and onerous new “wage transparency” mandates and penalties on ALL employers and industries. Although the Senate Labor Committee limited the California-style independent contractor test to the construction industry (NAICS Sector 23), the change will significantly hinder the industry’s ability to use contractors and subcontractors — including business-to-business relationships — ultimately driving up costs across the board.

New Jersey gives unions green light to file lawsuits against employers
January 15, 2024 // New Jersey has given labor unions the legal authority to file litigation against companies over alleged labor violations despite claims from business groups that it will result in a slew of lawsuits. The legislation, recently signed into law by Gov. Phil Murphy, will allow unions to represent workers or a third party in wage claim lawsuits against contractors and subcontractors for any debt owed for construction, reconstruction, demolition, alteration and maintenance projects.
Op-Ed: Biden’s joint-employer rule is bad for workers
November 9, 2023 // Included in the Employee Rights Act are the commonsense provisions of the Save Local Business Act, which would provide much-needed clarity in determining joint-employer status and prevent franchise owners from becoming corporate middle managers. More specifically, the bills amend the National Labor Relations Act and the Fair Labor Standards Act to clarify that two or more employers must have “actual, direct, and immediate” control over employees to be considered joint employers. It rolls back a convoluted joint-employer scheme that threatens job creation and undermines the American dream, and it restores a commonsense definition of employer to provide certainty and stability for workers and job creators. Simply put, the Employee Rights Act seeks to update our nation’s labor policies to match the needs of the 21st-century worker and workforce.
