May 21, 2025 // The workers are seeking an increased wage scale for Competency Evaluated Nurse Assistants (CENAs) and increased starting rates for Ciena workers in housekeeping, dietary, activities, cooking and maintenance. Other demands include shift differentials, annual raises for all workers, paid sick time, holidays and health insurance. The workers have been working without a contract for months, with some working without a contract since January of 2024.

May 16, 2025 // Ordinarily, employers try to get the NLRB to change a decision with which they disagree by challenging the decision on appeal. Employers also have the ability to argue to the Board in future cases, particularly after a change in administrations, that it should revisit its own precedent. The NLRB would then consider the issue and arguments and decide whether to change its earlier decision. However, the CDW has asked Bondi to unilaterally invalidate 15 Biden-era Board rulings, including 14 that set new precedents.
Federal Appeals Court Hears Arguments in Starbucks Baristas’ First-In-The-Nation Suit Challenging Constitutionality of NLRB
May 16, 2025 // Cortes and Karam’s case, originally filed in 2023, was the first in the nation to advance the argument that NLRB board members’ removal protections – which insulate members of the federal labor board from accountability to the President except on very rare occasions – violate separation of powers doctrines in Article II of the Constitution. Since Foundation attorneys filed the baristas’ case, the Trump Administration advanced the same arguments to remove Biden NLRB Member Gwynne Wilcox from the Board, which is now the subject of ongoing litigation.
