White House may nix pay for workers furloughed during shutdown
October 9, 2025 // Mark Paoletta, the OMB general counsel, wrote that the 2019 law is “not self-executing” and requires further appropriations to pay furloughed workers as part of stopgap legislation to end the funding lapse. The memo, which is labeled “pre-decisional and deliberative,” says that the requirement for “excepted” employees to keep working creates “binding legal obligations” to pay those workers. On the other hand, Paoletta writes there is no such obligation for furloughed workers who were “not performing services for the government” during the shutdown.
Federal workers unions call on Schumer, Jeffries to hold the line even if it means a shutdown
September 30, 2025 // In a letter to minority leaders Sen. Chuck Schumer and Rep. Hakeem Jeffries, the Federal Unionists Network and 35 local, council and national unions urged the Democrats to reject any proposal that cuts health care, social security, Veterans’ Affairs and scientific agencies. “We are directly impacted when the government shuts down: our members would no longer be able to work, get paid, or fulfill their mission of serving the American public,” the letter states. “But we believe the most important thing is fighting against the centralization of executive power and for the long-term survival of the critical services the federal government provides, even if that means allowing the government to temporarily shut down.” The American Federation of Government Employees — the largest federal union representing 820,000 federal workers — is not a signatory on the letter.
Democrats press discharge petition to restore federal worker union rights stripped by Trump
July 20, 2025 // Golden’s proposal has been endorsed by 221 other House lawmakers, including co-sponsor Rep. Brian Fitzpatrick (R-Pa.) and six other Republicans. And the discharge petition already has two GOP signatures attached: Fitzpatrick and Rep. Don Bacon (R-Neb.). To force a vote on the bill requires 218 signatures, meaning supporters will need four more Republicans to endorse the petition for it to be successful, assuming all 212 House Democrats sign on. Golden said he’s in conversations with the other Republican co-sponsors of the underlying bill — singling out New York Reps. Mike Lawler and Nick LaLota by name — in hopes of getting them to endorse the petition, as well.

March 11, 2025 // Democrats, led by Senate and House Minority Leaders Chuck Schumer and Hakeem Jeffries, both of New York, just reintroduced the Richard L. Trumka Protecting the Right to Organize Act. Named for a former head of the AFL-CIO, this bill, H.R. 20, does the same thing that California Governor Gavin Newsom claimed AB5 would do. The PRO Act aims to reclassify independent contractors as employees as a way to empower union organizers. As Jeffries put it in Congress: “When our unions are strong, the United States of America is strong.” Republicans, led by Rep. Kevin Kiley of California, put forward the Modern Worker Empowerment Act. This bill, H.R. 1319, aims to stop California’s experiment from spreading. It would protect everyone’s freedom to be our own bosses. As Kiley put it: “California’s disastrous AB5 law wreaked havoc on independent workers, stripping them of their ability to work on their own terms and forcing businesses to cut off contractor relationships. Shifting federal regulations threaten to impose similar uncertainty nationwide, putting millions of workers at risk.”
