The federal government is now appealing a court injunction keeping that agreement in force. Americans for Fair Treatment, of which I am CEO, has been fighting this battle for years. Congress never expressly granted collective bargaining rights to TSA screeners. The current union system began with a 2011 decision by Obama-era TSA Administrator John Pistole.

There is a similar notice on the TSA website. Shuker told Forbes he would expect a higher number of TSA employees to call out sick on busier travel days such as Sunday, Thursday and Monday. “If you were planning like stress day or a mental health day or an ‘F you’ day, you wouldn’t pick Tuesday because it's the lightest day of the week and the easiest to work,” Shuker told Forbes.
New documents show TSA screeners illegally unionized, pro-worker group says
February 11, 2025 // “During the Obama administration, the TSA administrator did an abrupt about-face, and TSA moved ahead with allowing screeners to unionize in violation of the law,” Dave Dorey, an attorney specializing in labor and employment law who represented AFFT, told the Washington Examiner. “Multiple administrators of TSA have stated publicly that TSA screeners are not covered by Title V, which includes significant rights for unionized workers — including the ability to file claims of unfair labor practices with an independent board and ultimately vindicate their rights in federal court. TSA screeners have none of these protections.”
