Trader Joe’s Bags A Victory At The Ninth Circuit
October 2, 2025 // Trader Joe’s had also asserted a dilution by blurring claim against the union, a claim the district court also dismissed on the basis that Trader Joe’s United’s use of the Trader Joe’s mark constituted nominative fair use. But unfortunately for the union, it had never raised this issue in its briefing before the district court. As such, Trader Joe’s never had the opportunity to test this theory and the Ninth Circuit held that the district court again erred in dismissing the dilution claim.
US labor board withdraws claims Apple CEO violated employee rights, Bloomberg News reports
October 2, 2025 // The U.S. labor board has withdrawn its allegations that Apple CEO Tim Cook violated federal labor law and several other claims, Bloomberg News reported on Friday. The office of the general counsel of the National Labor Relations Board said it was withdrawing many of the claims in a complaint it had issued against Apple in January, the report said, citing a letter.

Amazon sues New York over union protections
September 24, 2025 // In a lawsuit filed Tuesday in U.S. District Court in New York City, Amazon argues that a newly minted state law giving the New York State Public Employment Relations Board authority to oversee union elections and resolve unfair labor practice charges is an "unconstitutional power grab" that's preempted by federal labor laws. Amazon was seeking a temporary restraining order blocking the law, but U.S. District Court judge Eric R. Komitee rejected that request in an order issued late Tuesday, citing a lack of notice to defendants named in the lawsuit. Lawyers for Amazon said the New York law "flips U.S. labor law on its head" by giving the state's PERB jurisdiction over every private-sector employer "until the NLRB gets a court to hold otherwise."
