National Labor Relations Board sues to block New York labor law
September 22, 2025 // The suit claims that S8034A/A8590A creates a regulatory system in conflict with the National Labor Relations Act, alleging that it usurps the NLRB’s authority to regulate the private sector. It wants the court to declare the law invalid because it’s preempted by the NLRA under the Supremacy Clause of the U.S. Constitution. The complaint also asks the court for an injunction to stop the state from enforcing the law. S8034A/A8590A, signed into law by Gov. Kathy Hochul (D) at the New York City Labor Day Parade, amends the State Labor Relations Act to allow the PERB to enforce collective bargaining agreements and certify bargaining representatives. It took effect immediately upon being signed.

Strike allegations lead to heated board meeting
April 9, 2025 // The Town of Tonawanda held its first board meeting on Monday night since town supervisor Joe Emminger said that dozens of police officers will be charged with Taylor Law violations – and the police union showed up in full force in response to allegations that officers participated in an illegal strike. The gavel had to be used more than 10 times at a vocal and heated meeting. The union said that the town’s disciplinary actions against its own police force are a tipping point, so much so that Andy Thompson, president of the Town of Tonawanda Police Club, made his first public comments since the situation began. “What’s happening inside of our department should alarm every person in this room, and every family in this town,” Thompson said.

October 8, 2024 // Bell’s brief notably attacks UFW union lawyers’ theory that once a union is certified as the monopoly union “representative” of all employees in a work unit, there can be no option at all to remove an unwanted union. “[New York labor law] does not indicate that employees have a single chance at self-organization, and once they make a choice, they are no longer permitted to make any other choice regarding self-organization,” the brief says. “If that were the case, the very action of choosing a representative under Section 703 would deprive employees of the ability to exercise Section 703 in perpetuity….”
NEW YORK: Farmington employee sues town over labor union membership
June 12, 2023 // Hinman started working for the town in 2014 and joined the Teamsters in 2018. When he tried to resign his union membership in 2021, union officials refused to allow it and continued to deduct dues from his wages without his consent, Hinman claims. The lawsuit claims Hinman’s First and Fourteenth Amendment rights were violated, as well as his rights under New York state laws. Hinman wants his union membership resignation to be acknowledged and his dues refunded, with interest.
