July 6, 2023 // David Osborne, fellow at the Institute for the American Worker, told the DCNF that non-competes are a valuable tool for businesses. “Eliminating noncompete agreements would make it easier for union ‘salts’ to infiltrate American businesses; eliminating noncompete agreements would allow them to move more freely from business to business pushing unionization on other employees,” Osborne said. “But the more immediate effect is to put the government’s thumb on the scales of union organizers by removing a perfectly acceptable tool—noncompete agreements—that American businesses have long used to protect valuable intellectual property.” As for how the efforts will affect workers, Osborne said that inevitably, “unionized employers will have to be less trusting of employees, less generous, and stricter about who receives access to valuable intellectual property, knowing that employees can immediately secure a job with their closest competitors at any time.”

May 22, 2023 // SB 256 outlaws requiring the state to deduct union dues, restricts the freedom of educators and other working people to join unions, forces local unions to undergo monitoring, and requires that an arbitrary 60% supermajority of eligible employees pay dues in order for a union to exist. “Dues will no longer be deducted from their paycheck along with Medicare, Medicaid, Social Security, and taxes,” Brown told the Florida Record. “Union dues don't belong on there anyway. The state should not be collecting money on behalf of private organizations anymore. Unions can just call their members and get their credit card information, their bank account and have it set up as a direct payment that way if they would like to.” Defendants include Donald J. Rubottom, chair of the Florida Public Employees Relations Commission, Jeff Aaron, commissioner of the Florida Public Employees Relations Commission, and Michael Sasso, commissioner of the Florida Public Employees Relations Commission.
ARKANSAS BILL WOULD END GOVERNMENT COLLECTION OF UNION DUES FROM TEACHERS’ PAYCHECKS
March 28, 2023 // Just weeks after passing the largest education reform in state history, Arkansas lawmakers are now considering a bill that would better protect both taxpayers and teachers in the Natural state by preventing government employers from deducting union dues or political contributions from public school employees’ paychecks. “Gov. Sarah Huckabee Sanders has taken major steps to make good on her promise to be the education governor that others should aspire to,” said Rusty Brown, southern director for the Freedom Foundation. “The governor has already signed into law the largest teacher salary increase in state history, moving Arkansas from having some of the lowest teacher salaries in the country to among the five highest in the nation. I defy any teachers’ union to show where they’ve done the same.”

And when you have a union whose membership is half [the people they represent] … then that could be indicative of a problem. … [This bill] gives the employees represented by the union the opportunity to vote … if they would like to continue allowing that union to represent them.”

Beyond the inflation act, Democrats, with help from a few Republicans, were able to add prevailing wage requirements to the semiconductor bill. And both the Energy and Transportation Departments are making clear that access to unions, payment of prevailing wages and commitments to local hiring will be big advantages for competitive bidders seeking infrastructure and highway electrification projects, though Republican governors like Joe Lombardo in Nevada are trying to block some of those requirements.
