    OPM finalizes performance review overhaul for federal employees

    July 7, 2026 // Along with limiting how many employees can be deemed high performers, OPM’s final rule also eliminates “level 2” of the government’s five-level scale for employee performance ratings; removes the ability for employees to contest their performance ratings through grievance and arbitration proceedings; and requires OPM to review agencies’ performance rating systems every other year. Supervisors’ performance reviews will now be tied, in part, to “driving a culture of accountability,” and they will have to complete additional training on the new rating system. Also under the final rule, agency officials will no longer be required to review any “unsatisfactory” performance ratings.

    Labor Department toughens union transparency rules

    June 9, 2026 // The purpose of the changes (and less substantial changes to the LM-2 for unions reporting receipts of $350,000 to $39,999,999) are to carry out the purposes of the LMRDA (and the consensus principle it codified): Ensure union members, prospective union recruits, and the public can appropriately track the use of member dues and compulsory fees required of workers in non-right-to-work states.

    OPM Issues Final Rule Which Allows Agencies to Remove Workers Who Refuse to Implement the will of the American People

    February 6, 2026 // I4AW’s commentary was referenced or quoted seven times in the final rule! The rule, called “Improving Performance, Accountability and Responsiveness in the Civil Service,” authorizes agencies to move policy-influencing positions into Schedule Policy/Career, which will “allow agencies to quickly remove employees from critical positions who engage in misconduct, perform poorly, or obstruct the democratic process by intentionally subverting Presidential directives.” Institute for the American Worker submitted a formal comment when the proposed rule was first announced, providing arguments on the need for accountability regarding obstructive government workers.

    Hadley, MA, Trader Joe’s Employees Seek Vote to Remove SEIU-Backed Union Officials from Store

    August 13, 2024 // Employees at the Hadley, MA, location of grocery chain Trader Joe’s have submitted a petition seeking a workplace election to remove the Trader Joe’s United union, an affiliate of the large Service Employees International Union (SEIU). Trader Joe’s employee Les Stratford submitted the petition to National Labor Relations Board (NLRB) Region 1 in Boston with free legal aid from National Right to Work Foundation staff attorneys.
