    New Jersey Energy Workers Win Bid to Remove Unwanted Union

    March 24, 2023 // Calmac Corp employee Carlos Flores and his coworkers have won their effort to free themselves of the Sheet Metal, Air, Rail, and Transportation (“SMART”) Local 137 union. The worker’s decertification effort recently became official when the SMART Local 137 union officials preemptively “disclaimed” interest in representing the Calmac Corp workers, rather than face a vote on whether to remove the union. Flores, during the course of the decertification effort, received free legal aid from National Right to Work Legal Defense Foundation attorneys. The decertification petition, filed with the National Labor Relations Board (NLRB), included the signatures of a significant portion of his coworkers. The Calmac Corp employee petition was filed on March 7, 2023. The petition was quickly followed by a letter from union officials, disclaiming interest in “representing” Calmac Corp workers. Luckily for the Calmac workers, the entire decertification process was completed rather quickly. However, this is not always the case for many workers around the nation who are also working to remove overbearing unions.

    September 20, 2022 // Kerry Hunsberger leads an employee push to vote out the Steelworkers union at Latrobe Specialty Steel. Hunsberger’s attorneys filed a brief this week at the National Labor Relations Board (NLRB) arguing that union officials concocted an improbable contract ratification story to avoid being voted out by the workers they claim to “represent.” The union bosses admit to signing the unpopular contract behind workers’ backs in an attempt to trigger the NLRB’s so-called “contract bar” policy. The “contract bar” arbitrarily immunizes unions from employee decertification votes for up to three years after a contract between union and company officials is finalized.

    St. James Mayo Clinic Nurses Overwhelmingly Vote to Remove AFSCME Union; Certified by Labor Board

    August 2, 2022 // National Right to Work Foundation legal aid has recently assisted workers in several decertification efforts in Minnesota. In addition to the St. James Mayo Clinic, hundreds of nurses at Mayo Clinic in Mankato, Minnesota recently voted to remove the Minnesota Nurses Association. Meanwhile, two groups of employees at four Cuyuna Regional Medical Center locations recently filed petitions seeking decertification votes seeking to remove SEIU union officials. Because the NLRB has made the decertification process unnecessarily complicated, workers often need to turn to Foundation attorneys for free legal aid in navigating the process. The Foundation recently aided metalworkers at Minneapolis Washer and Stamping, who endured a year and a half of litigation, but have finally voted out Communications Workers of America (CWA) union officials.

As we know in Michigan, once the UAW becomes embedded into a facility, they will never allow a recertification vote or any attempt by workers to decertify. Once voted in, workers are stuck with the UAW for generations to come. It will simply be forced upon them as a condition of employment. Over the last couple of decades, autoworkers in the South – when granted their right to a secret ballot – have demonstrated time after time that they are not interested in what the UAW has to offer. Those 11,000 future autoworkers in Kentucky and Tennessee deserve those same rights, freedoms, and protections
