I understand why you want to help unions: Membership is at an all-time low, and Gallup says 80% of people either don’t want to join a union, or are at best neutral on the subject. But when you try to solve that union problem by destroying the livelihoods of independent contractors, all you do is come off as extremists.

April 16, 2024 // .A California-based tutoring company provides one anecdotal example of the consequences. The company has already let go independent workers in the Golden State and—in anticipation of the nationwide DOL rule—has announced terminations in Massachusetts and New Jersey. It’s the proverbial canary in the coal mine. If Congress doesn’t act, the DOL’s rule risks replicating California’s dysfunction on a national scale. One estimate predicts the independent workers impacted by this rule could face more than $30 billion in lost income. That tracks with a recent Mercatus Center study on the impact of AB 5 in California. It found that after the law was implemented, self-employment decreased by more than 10 percent on average for affected occupations. Overall employment decreased by more than four percent.

February 5, 2024 // Self-employment fell by 10.5 percent on average for non-exempt occupations, while overall employment fell by 4.4 percent on average for non-exempt occupations Occupations with a greater prevalence of self-employed workers saw greater reductions in both self-employment and overall employment In other words, on average, 1 in 10 self-employed individuals may have lost self-employment opportunities in California among occupations not exempt from AB5, while there is no evidence of an accompanying increase in traditional employment opportunities among workers in non-exempt occupations.
San Diego Gompers Preparatory Academy Charter School Educators Vote Out SDEA Union
June 21, 2023 // Even worse, shortly after the PERB’s ruling halting the original decertification effort, Chiscano and another Gompers educator filed charges maintaining that SDEA agents targeted them on social media for opposing the union hierarchy. California law makes it illegal for union officials to intimidate or retaliate against employees who exercise their right to refrain from union membership. Union boss-aligned state legislators even chimed in to pressure Gompers management to give in to union demands. In a letter to Gompers management, then-Assemblywoman Lorena Gonzalez (now an AFL-CIO president) attacked the National Right to Work Foundation for simply providing legal aid to Gompers educators as they sought to exercise their right to hold a decertification election. Gonzalez was best known during her tenure for authoring AB5, a California law that drastically reduced opportunities for freelance workers and independent contractors across the state.
Julie Su: At Big Labor’s beck and call
May 1, 2023 // While at the LWDA, she supported anti-worker laws like AB 5, a law that reclassified contractors and freelancers as regular employees. The implementation of AB 5, which happened under Su’s watch, was perceived as heavy-handed and punitive towards contractors and freelancers. Su openly stated that she was willing to conduct “investigations and audits” to enforce reclassification, which negatively affected contractors and freelancers. But contractors and freelancers disagreed with Su’s interpretation of AB 5’s effects on workers. An independent truck driver, who was forced to reclassify after AB 5’s passage, said that AB 5 will “kill the liberty of being a trucker” because of all the “regulatory stuff in an over-regulated and complex industry.”
The Freelance Worker Protection Act criticized as overreach, bad for Illinois business
March 30, 2023 // The Freelance Worker Protection Act in House Bill 1122 requires written contracts for workers and several requirements on payment. “We know that it is an increasingly growing sector of our labor market and we want to make sure that people who are doing freelance work have the same basic protections that other workers do as well,” state Rep. Will Guzzardi, D-Chicago, said. The legislation would authorize the Illinois Attorney General to get involved if someone is believed to have violated any provisions of the bill. State Rep. Dan Ugaste, R-Geneva, said the measure is an overreach and another example of government interference.

March 14, 2023 // California Assemblywoman Cottie Petrie-Norris, the Democrat who chairs the Accountability and Administrative Review Committee, told the LA Times, "(Su) has done a tremendous job on many different initiatives, but she has not done a good job at running the Employment Development Department and, as a result, has wasted billions of dollars and, more importantly, caused heartache for millions of Californians." Su also championed the drive to hike California’s minimum wage, a move wildly popular with her union allies, but one that poured gasoline on the fire burning in the state’s alleys, boosting retail prices, moving home ownership beyond the reach of even more state residents and forcing businesses to lay off low-skilled workers they could no longer afford to employ.
