NLRB confirmations secure Republican majority
August 11, 2026 // The Associated Builders and Contractors in a Friday statement commended the confirmation of Macy and Prouty, noting that losing a quorum would have left NLRB "unable to issue decisions, creating additional uncertainty for the construction industry and the broader employer community." "A fully functioning NLRB is essential to reducing the growing case backlog and ensuring labor disputes are resolved in a timely and predictable manner," Kristen Swearingen, ABC vice president of government affairs, said. In addition to the NLRB confirmations, the Senate also confirmed economist Brett Matsumoto to a four-year term as DOL's Commissioner of Labor Statistics.

Trump taps veteran labor lawyer to fill out Republican NLRB majority
April 14, 2026 // Trump's appointees are expected to target a series of labor board policies favored by unions that have helped fuel a spike in union organizing in recent years. But board rules require three members to vote in favor of overruling existing precedent, and Murphy and Mayer said during confirmation proceedings that they would not break with that practice. Murphy and Mayer have already revived a rule adopted by the NLRB during Trump's first term that makes it more difficult to hold companies liable as the "joint employers" of contract and franchise workers, and relinquished jurisdiction over a case involving Elon Musk's SpaceX to a different federal labor agency.
US Senate confirms Trump nominees for labor board paralyzed after member’s firing
December 19, 2025 // Trump's appointees to the board are expected to undo a series of decisions issued by Wilcox and other appointees of Democratic former President Joe Biden that have been criticized by business groups and Republican lawmakers. Under a decades-old policy, the board typically does not overturn its existing precedent unless three members vote to do so. Trump has not yet named a nominee that would give the board a third Republican member, but Mayer and Murphy in the meantime could issue decisions narrowing the reach of Biden-era decisions. That includes a 2023 ruling that allows unions to represent workers in some instances even after losing an election, a ban on the common employer practice of holding mandatory meetings to discourage unionizing and an expansion of monetary remedies available to workers who are fired for supporting unions or other protected conduct.
Schumer moves to lock in place Democrat-majority labor board
December 11, 2024 // Senate Democratic leader Chuck Schumer is attempting to ensure that the Democrats retain control of the National Labor Relations Board, the main federal labor law enforcement agency, until at least 2026 by extending the term of its current chairwoman, Lauren McFerran. A Senate floor vote on McFerran’s nomination is pending and, while it is possible that Senate Republicans could block it, it is not clear if enough will show up for the vote to do that. The vote may happen on Wednesday. This matters because the current board has been an aggressive advocate for unionization.

The Biden administration has renominated her, and Senate Democrats on the Health, Education Labor and Pensions committee are attempting to fast-track her approval. Extending her term would ensure Democrats retain a functioning majority on the quasi-independent board until at least 2026, and possibly until 2028, even if likely presidential nominee Kamala Harris should lose in the fall. As much as unions and their allies talk about giving workers a voice, they usually oppose workers having the right to hold their unions to account.
