100 State Leaders Urge Washington to Protect Independent Work
May 8, 2026 // That is why State Policy Network’s Center for Practical Federalism helped organize a coalition of 100 state leaders from 25 states in support of the US Department of Labor’s proposed rule clarifying independent contractor status under federal law. The coalition includes four statewide officials and 96 state legislators. The proposed rule would rescind the Biden administration’s 2024 independent contractor rule and replace it with a clearer standard for determining when a worker is an employee and when a worker may be classified as an independent contractor under the Fair Labor Standards Act, the Family and Medical Leave Act, and the Migrant and Seasonal Agricultural Worker Protection Act.

Later, he came to resent having to support an organization whose values clashed with his own and sought to opt out — just as hundreds of thousands of public employees have since Janus v. AFSCME affirmed their First Amendment right to do so in 2018.
Thousands of Michigan home health care workers vote to unionize
October 14, 2025 // The Mackinac Center of Public Policy is leading that lawsuit. Senior Attorney Derk Wilcox said the state can’t just label people as state employees for the sake of unionizing them. “The state constitution specifically says that all employees of the state government go through the civil service. The civil service manages them and sets the terms of employment. And this is an attempt to bypass that,” Wilcox said. The complaint cites language in Article 11, Section 5 of the state constitution, which details who counts as a part of the state civil service and falls under the Michigan Civil Service Commission’s purview.
