    Small Businesses File Lawsuit Challenging DOL’s Independent Contractor Rule

    March 5, 2024 // NFIB opposed DOL’s 2024 final rule on independent contractors, arguing that the rule further complicates the worker classification process for small businesses. Small business owners supported the 2021 rule, which offered a straightforward test for determining who is and is not an independent contractor. NFIB filed the complaint with the Coalition for Workforce Innovation, Associated Builders and Contractors of Southeast Texas, Associated Builders and Contractors, Inc., Financial Services Institute, Inc., Chamber of the Commerce of the United States, National Retail Federation, and American Trucking Associations.

    A Labor Strike Over Shoplifting

    November 29, 2023 // Ms. Luick says workers at her store “frequently observe shoplifting and even occasional violence,” and “the lack of security affects our customers too.” But when she called 911 about “a repeat shoplifter that even law enforcement was familiar with,” Macy’s suspended her without pay “for nearly three weeks,” she wrote in a letter to the Everett Herald last week. Now Macy’s workers “are afraid to call the police because we worry we’ll get in trouble or even lose our jobs,” she said. Macy’s declined to respond to Ms. Luick’s claims but said “our top priority is to ensure the safety of our colleagues and customers in-store.” UFCW Local 3000 said it filed an unfair labor practice charge against Macy’s over its treatment of Ms. Luick and that the company “eventually provided back pay.”

    U.S. labor board delays new unionization rule after business groups sue

    November 20, 2023 // The U.S. Chamber of Commerce and other business groups — including the American Hotel and Lodging Association, the International Franchise Association and the National Retail Federation — sued the NLRB in federal court in Texas last week to block the rule. They say the rule upends years of precedent and could make companies liable for workers they don’t employ at workplaces they don’t own. But the NLRB says the current rule makes it too easy for companies to avoid their legal responsibility to bargain with workers.

    Biden administration working overtime to regulate working overtime

    September 5, 2023 // ederal law says employees must be paid time and a half once they work more than 40 hours in a week. However, businesses may exempt workers from the requirement if their duties are “managerial” in nature and they reach a certain salary threshold. Currently, workers had to earn at least $35,500 annually before they were covered. The new rule, which goes into effect at the end of the year, raises that by almost $20,000. The administration estimates this would extend the rule to 3.6 million additional workers. The problem with the change is that it limits employers’ ability to work out alternate arrangements with employees where they work more than 40 hours in exchange for some other consideration, such as additional time off on other weeks. Under the new rule, employers are more likely to simply cut hours than to have to pay overtime at all.

    UPS, Teamsters accuse each other of walking away from contract talks

    July 6, 2023 // The Teamsters Union said on Wednesday United Parcel Service "walked away" from negotiations over a new contract, a claim the shipping giant denied, lobbing its own accusation that the union had stopped negotiating. The two sides traded salvos in early morning statements as they attempt an agreement to prevent a strike when the current contract, which covers some 340,000 workers, expires at the end of the month.

    Labor dispute snarls West Coast ports; White House urged to step in

    June 7, 2023 // The maritime association contends members of a dockworkers union have engaged in “concerted and disruptive work actions” for several days. “Union leaders are implementing many familiar disruption tactics from their job action playbook, including refusing to dispatch workers to marine terminals, slowing operations, and making unfounded health and safety claims,” according to a statement the association posted late Monday on Twitter. When asked for comment Tuesday, union officials referred to a statement released Friday by ILWU President Willie Adams. He pointed to “historic” profits made by port operators, which the union estimated topped $510 billion during the pandemic.

    White House Urged to Intervene in West Coast Port Labor Talks

    March 28, 2023 // A group of more than two hundred importers, exporters, logistics providers, and retailers urged the White House to intervene in West Coast port labor talks that have been underway since last May. In a letter March 24 to President Joe Biden, groups including the National Retail Federation, the American Trucking Associations, and the U.S. Chamber of Commerce, urged the administration to help speed the agreement on a new labor contract between the International Longshore and Warehouse Union and the Pacific Maritime Association, after the contract governing dockworkers from California to Washington State expired on July 1. “While we appreciate that the parties agreed not to engage in a strike or a lockout, we are aware of several instances of activities that have impacted terminal operations. We need the administration to ensure these activities do not continue or escalate,” the March 24 letter said.

    Rideshare, retailers brace for tough U.S. independent contractor rule

    September 28, 2022 // The meetings at the White House were one-sided, with officials at OIRA letting groups speak and not participating or asking follow-up questions, several employer sources said. They are interpreting that as a sign the Biden administration's mind is made up. Some of the groups have been trying, and failing, to convince the White House that any broad rule would hurt workers who want to remain independent and have flexibility...More than one-third of U.S. workers, or nearly 60 million people, performed some sort of freelance work.
