June 5, 2024 // Unions defend this anti-democratic system as a necessary response to corporate shenanigans, but that claim ignores how the deck is stacked in unions’ favor. Unions have an incentive to allege illegal activity regardless of whether it happened, and under the Biden administration, the NLRB is much more inclined to agree with unions. The Cemex decision itself is proof of the board’s union bias. The NLRB is run by people appointed by the self-described “most pro-union president ever.” Lo and behold, they make pro-union decisions. The Alabama autoworkers should be terrified. They couldn’t have been clearer in their rejection of the UAW.

May 28, 2024 // After Unite Here union officials imposed union control over hotel employees without a secret ballot vote, workers at Sofitel Washington DC Lafayette Square have successfully obtained an election to remove the union. Sofitel employee Mwandu Chibwe submitted on May 15 a petition asking the National Labor Relations Board (NLRB) to hold a decertification election at her workplace. Ms. Chibwe is receiving free legal aid from the National Right to Work Legal Defense Foundation.
Congressional Testimony Exposes Union Tactics to Undermine Elections
May 27, 2024 // One of the most popular tactics unions use to drive support is a process known as card check. Union organizers hand workers cards to sign as a way to indicate support for the union. Workers are typically asked to sign these cards in front of organizers, adding an extra layer of pressure when a vote is done publicly. Some unions have intimidated workers who may be reluctant to sign, showing up at people’s homes and threatening a worker’s family. As Delie explains in his testimony, a better way to ensure that an election is fair and workers are free from intimidation is to use secret ballots in union elections.
Major agricultural firm sues California over farmworker unionization law
May 16, 2024 // Under the law, once a union is certified, employers must enter into collective bargaining within 90 days, Wonderful said in its lawsuit. That would be June 3 for the newly formed union at Wonderful Nurseries in Wasco, Calif., that was certified by the state’s Agricultural Labor Relations Board. Wonderful filed a complaint with the board, saying its workers didn’t want a union. The company says many employees thought the cards they signed were to access $600 payments under a federal pandemic relief program administered by the UFW, the largest farmworker union in the U.S. The UFW denied the allegation.
Wonderful Nurseries Workers Hit UFW Union with Charges Detailing Fraudulent Union Campaign, Illegal Discrimination
April 27, 2024 // With the union installed and UFW agents not letting workers revoke their illicitly-obtained memberships in the union, Chavez and Gutierrez note that UFW union officials are now “engaging in a campaign of harassment, libel, slander, and intimidation against [employees who are] exercising their right of free speech and/or protest under [California labor law] to oppose UFW representation.” News reports suggest that scores of Wonderful Nurseries workers have engaged in outdoor demonstrations against the union, declaring “We don’t want a union, listen to our voices, don’t ignore us.” In addition to the ALRB charges, Chavez and Gutierrez, along with a dozen other coworkers, seek to intervene in the ongoing ALRB case in which Wonderful Nurseries is challenging the union’s card check majority “certification” as improperly based on cards collected through fraud and other improper means. Foundation staff attorneys represent the group of workers seeking to intervene in that case to defend their right not to be placed under union monopoly control as a result of UFW organizers’ illicit tactics. Graduate students file for union election, marking last Ivy to do so
April 17, 2024 // Gaby Nair GS, an organizer with PGSU, told the ‘Prince’ that a “strong majority” of graduate students had signed union cards. The threshold for an NLRB election is 30 percent. PGSU was unable to provide a specific number of signatories to the ‘Prince.’ “We’re really looking forward to getting [an election] date … hopefully that process goes smoothly. We’ve seen it not go smoothly at some of our peer institutions,” Nair said, referencing unionization efforts at the University of Pennsylvania. There, graduate students initially filed for a union election in October, but were delayed by an NLRB ruling that declared roughly 300 students under certain educational fellowships ineligible. The union at Penn was set to vote this Tuesday and Wednesday, but it was rescheduled to May 1 and 2. Princeton has been slower to unionize than some of its peer institutions. Apart from Penn, all other Ivy League universities have formally recognized graduate student unions.
Alabama bill cutting economic incentives to keep unions from ‘strong arming employees’ advances
April 5, 2024 // An Alabama Senate committee Wednesday approved a bill that would withhold economic incentives from companies that voluntarily recognize unions or do not hold secret ballots in union elections. . SB231, sponsored by Sen. Arthur Orr, R-Decatur, passed the Senate Fiscal Responsibility and Economic Development Committee on an 11-3 vote, down party lines.
