Lamm and her colleagues signed the petition after FLRA officials administratively merged her work unit with another without any vote by her and her fellow employees on the new arrangement. Union officials and the FLRA then cited the merger as a reason to block the decertificiation vote the workers requested. The brief challenges the FLRA’s suspect position that, under the Federal Service Labor-Management Relations Act, an employee-requested election to remove a union can be blocked after a union is installed by agency fiat through “unit consolidation.” The only “election bar” authorized by the statute is one for 12 months after employees have voted to install a union by secret ballot, the brief argues.

The request seeking to end MNA union officials’ monopoly bargaining powers at the Mayo Clinic was signed by more than two hundred nurses in the bargaining unit, well over the number needed to trigger an NLRB-conducted secret ballot vote to remove the union. Minnesota is not a Right to Work state, meaning workers can be forced to pay dues or fees to union officials as a condition of getting or keeping their jobs. If the workers’ vote is successful, MNA union officials will be stripped of their monopoly “representation” powers, including the ability to impose a forced dues requirement on the nurses in the bargaining unit.

    April 13, 2022 // The Employee Rights Act contains several other provisions to protect workers from union intimidation. The bill criminalizes union threats in the workplace and bans unions from using personal employee data for anything unrelated to campaigns, taking Big Labor’s most aggressive and unethical tactics off the table. The bill also prohibits union “salting,” a tactic where a union pays an individual to apply for a job within a company that has not yet been unionized. Instead of becoming a productive employee, the “salt” is there to organize a union and be Big Labor’s mole on the inside.

    February 16, 2022 // Penske Truck Leasing employee Steven Stuttle filed the decertification petition for his coworkers who want to oust the unpopular union. Thirty percent of workers’ signatures are needed to trigger a NLRB-conducted secret ballot vote to remove the union. This request was signed by all but one of the workers in the bargaining unit.

If the nurses vote in favor, the Massachusetts Nurses Association, or MNA, will no longer represent the union; the contract they fought so long to win will become null and void; and the nurses will face at least a year without any union protection at all.
