Is It Really About Employee Voices? The National Labor Relations Board Continues its Union-Friendly Trend

August 7, 2024 // The new regulations also contain a revision that will affect construction companies. Under the NLRA, an employer cannot recognize and bargain with a union lest the union has demonstrated that it represents a majority of the employees (through cards or an election, as noted above). Section 8(f) of the NLRA provides a limited exception to this rule, and it applies solely to the construction industry. Under Section 8(f), a construction industry employer can enter into a "pre-hire" agreement with a union and negotiate employment terms regardless of whether the employees support the union. Prior to 2020, the Board allowed an employer and union to convert an "8(f) agreement" into a normal collective bargaining agreement simply by stating that the union had demonstrated majority support to the employer. That language was sufficient to block a decertification petition or petition from a rival union during the so-called "contract bar" period (the term of the labor agreement, up to three years). No evidence would be examined to attack the contract language – this provision was enough.

Texas Judge Enjoins NLRB From Proceeding Against SpaceX, Casting Further Doubt on NLRB’s Constitutionality

July 31, 2024 // If the lawsuits ultimately succeed and the NLRB is dismantled in whole or in part, we may see a dramatic transformation of the way union organizing, elections, and worker and union disputes are decided under the National Labor Relations Act (NLRA). We will continue to monitor developments in these cases, as well as the expected wave of challenges to the NLRB’s rules and positions.

Disneyland workers reach tentative deal with company, averting strike

July 25, 2024 // The bargaining committee previously accused Disney of having "engaged in multiple instances of conduct we allege are unfair labor practices, including unlawful discipline and intimidation and surveillance of union members exercising their right to wear union buttons at work." The union buttons in question depict a Mickey Mouse-style white glove raised in a fist. (The company has insisted that costumes worn by cast members are "a critical part of enhancing the experience of our Disney show.")

Right-to-Work law repeal more than doubles federal complaints

July 24, 2024 // Since February, the number of cases filed with the National Labor Relations Board has doubled the total for last year, according to one advocate for workers. The National Right to Work Foundation says it fielded over 27 inquiries concerning workers’ rights in the last six months, and it has filed 10 cases with the federal agency. In 2022, the foundation filed six complaints on behalf of workers in Michigan. It filed four in 2023 but has filed at least 10 as of July 18. A foundation employee said that another 10 are likely.

The company submitted nearly 150 signed declarations from nursery workers saying they had not understood that by signing the cards they were voting to unionize.

According to the NLRB, objections were filed by the union and workers seeking union recognition following the March vote. Those documents were not available to be viewed by publication time Tuesday.

Minneapolis park workers strike prompts war of words and some cancellations

July 11, 2024 // “Threatening they would lose their jobs, threatening demotions or taking away seniority… and also telling them they would not be allowed to come back to work until the strike was resolved and the contract has been ratified which is illegal,” said AJ Lange with LIUNA 363. A spokesperson for the board shared information that was sent out to employees Monday afternoon. It said “The Minneapolis Park and Recreation Board was made aware that striking Local 363 employees plan to return to work on Thursday, July 11. The MPRB will welcome all striking employees back on Thursday. No employee who went on strike will be turned away.”
