Op-ed: I Beat My Union in Court. Did Oregon Forget?
January 6, 2026 // Unions are bleeding members. Workers are exercising their rights by resigning, keeping their dues money in their own pockets instead of funding political causes with which they don’t agree. Instead of making themselves more appealing to workers, unions lobbied the state government to criminalize speech and the rank-and-file’s desire to exercise their freedom of association. Oregon says the Freedom Foundation’s mailings “confuse” workers. What’s most confusing is why a state would make it illegal to tell workers about their constitutional rights while allowing unions to send unlimited recruitment mail.
Oregon Punishes the Freedom Foundation
December 30, 2025 // The censorship is masked in the good-government language of fighting fraud, but don’t be fooled. The Workers Fraud Protection Act, which takes effect Jan. 1, makes it “unlawful to falsely impersonate a union representative” and imposes punitive fines. The law cites a definition of fraud that includes merely giving a “false impression” of union matters. The bill was written specifically to give unions a cudgel against the Freedom Foundation. The nonprofit sends mailers informing workers of their right to decline union representation. Unions say the Freedom Foundation misleads workers by using union colors and logos to make the mail seem as if it is coming from the union itself.
Op-Ed Aaron Withe: Public-Sector Unions Have a Transparency Problem
December 18, 2025 // California takes it a step further. State law actually prohibits public employers from informing workers of their constitutional right to opt out. The Freedom Foundation is challenging these “gag rules” in court on behalf of Shasta County. The government actively prevents workers from learning the truth because it serves union financial interests. If unions provided valuable services that members wanted, they wouldn’t need to ensnare people through intimidation and bureaucratic obstacles.
A third of Colorado Springs School District 11 teachers strike
October 8, 2025 // "CSEA is throwing a temper tantrum because they've lost power," said Jason Dudash with the Freedom Foundation, "Most teachers are still in the classrooms, they're happy with this new arrangement not being any longer beholden to the union." Counter protestors argue that if the teachers on strike cared about the students, they would be in the classroom.

September 8, 2025 // Protect workers’ right to a secret ballot in union elections. Preserve flexible self-employment career-paths across American industries. Protect small businesses that operate as franchises and vendors for other businesses. Give workers control over their personal information during union campaigns. Allow workers in Right-to-Work states to opt out of union representation. Require opt-in consent for union political spending. Prohibit mandatory DEI mandates in union contracts. Ensure only citizens or authorized workers vote in union elections.
Kamala Harris pro-union X post inspires major Labor Day backlash
September 2, 2025 // An X post from former Vice President Kamala Harris on this Labor Day has generated hundreds of mostly critical comments. “When unions are strong, our communities and our country are strong. Every person in our nation has benefited from the labor movement. This Labor Day, we celebrate the workers and unions who have fought for fair wages, safe workplaces, and sick leave for all of us,” posted Harris. One commenter posted in response, “The Dems talking point for today is…UNIONS. Today is literally for the worker but in true form, democrats make it about the evil system.”
Opinion: We can’t abolish America’s largest teachers union. But Congress can do something else
August 7, 2025 // If this is what happens when NEA completely controls an event and its programming, the union’s tremendous influence over classrooms is a five-alarm fire not just for public education, but the future of our country. Congressional action addressing the pernicious influence of the teachers unions is long overdue. That’s why I (Mr. Fitzgerald) and Sen. Cynthia Lummis from Wyoming have introduced the Stopping Teachers Unions from Damaging Education Needs Today (STUDENT) Act, which would overhaul the NEA’s federal charter to make the union more accountable and less partisan.

June 10, 2025 // “He remains anonymous because what happened to him was so horrifying and caused him so much PTSD that he doesn't want to come out with his name,” said Freedom Foundation Litigation Counsel Shella Alcabes. “He's scared of the kind of retribution he's going to get.” Alcabes told The Center Square, their client, a high school math teacher-opted out of paying union dues to PAT, but is still required to be represented by the association in collective bargaining negotiations with his employer. “He worked for one school where he was bullied and harassed. He eventually was able to move to another school, but that doesn't change that PAT still represents him,”
Youngkin administration moves to protect public employees and taxpayers from union excesses
May 27, 2025 // First, the regulations would expressly extend to public employees the right to select a union pursuant to a secret-ballot election. In so doing, the proposed rules would protect public employees from being pressured or coerced into unionization via the infamous “card check” process, by which union organizers approach employees directly about publicly signing union petition cards. In its brief comment on the proposed regulations, the Virginia Education Association (VEA) claimed that, “All collective bargaining resolutions adopted by Virginia school boards, to date, provide for free and fair secret ballot elections…” But, as the Freedom Foundation documented in its comment, this is simply incorrect:

April 23, 2025 // The nonpartisan Legislative Counsel confirmed that existing Oregon laws already protect unions from legitimate false impersonation— which is what proponents say is the intent of the bill. But those laws don’t allow them to sue their biggest political opponent, the Freedom Foundation, because the Freedom Foundation doesn’t falsely impersonate unions, as our testimony explained. But with HB 3789, Oregon’s largest special interest group has written themselves new rules that would open the floodgates for state sanctioned lawfare against their largest opponent.
