Congress must embrace policies that remove barriers to the modern labor market, not stifle the individual who wants to work. As the economy evolves, labor laws should support worker choice, economic participation, and innovation. These bills are a critical step forward and deserve broad bipartisan support.

New Study: From Gig to Gone? ABC Tests and the Case of the Missing Workers
January 10, 2025 // The introduction of an ABC test caused significant declines in traditional (W-2) employment, self-employment, and overall employment. The ABC test reduced traditional (W-2) employment by 4.73% Self-employment fell by 6.43% Overall employment fell by 4.79% Occupations with high shares of independent contractors experienced the largest reductions in employment. These results suggest that contrary to the intended goal, ABC tests are not altering the composition of workers and leading to more workers becoming traditional W-2 employees, but they are reducing employment for both W-2 employees and self-employed workers.

OPINION Why don’t unions have to stand for reelection?
September 16, 2024 // The federal Bureau of Labor Statistics reports that 7.4 million workers in the private sector belonged to labor unions in 2023. Yet according to a new study from the Institute for the American Worker, which promotes market-oriented labor reform, fewer than 400,000 of those unionized employees — about 5 percent — have ever voted in an election for the union that represents them. Like me, the vast majority of employees in unionized workplaces were hired after the union had already been voted in. Most unions have never been required to confirm that they have the support of current workers by winning a recertification election. In some workplaces, a lifetime has elapsed — that isn’t hyperbole — since the union was first certified. The United Auto Workers organized General Motors’ Michigan plants in 1937 and has represented the employees who work there ever since. Never once has it had to stand for reelection. What kind of “workplace democracy” is that?

August 5, 2024 // These side hustlers are in addition to the millions of Americans who already earn all of our income as independent contractors. Many of us believe that this way of making a buck, with multiple streams of income, empowers us to avoid the kind of all-or-nothing layoffs that come with traditional jobs. Make no mistake: Having the ability to pick up a side hustle or go freelance is like a safety net in the back of many Americans’ minds. If, for whatever reason, we want or need to earn extra cash, we know this option exists.

May 4, 2024 // Sixty-eight percent of the respondents in our survey said that generative AI makes them more likely to pursue an independent career working for multiple companies. Ninety-two percent said that generative AI tools increased their productivity. And 80% said that generative AI increases their earning potential. A smaller portion, 16%, said they had already raised their hourly rates. This, then, is the counter-narrative: Thanks to AI, the most highly-skilled freelance product builders are becoming super builders—boosting their productivity and earnings.

New Study on California AB5 and Implications for the Department of Labor’s Independent Contractor Rule
January 18, 2024 // 1. First, employers may have hired some, but not most, independent contractors as employees, while other employers may have stopped working with their contractors based in California altogether. 2. Second, some employers may have extended employment opportunities to independent contractors who then declined such offers. Workers with a strong preference for flexible hours or for working with multiple clients, for instance, may not have wanted to work as traditional employees with one company. 3. Third, some small business owners may have been forced to shut down if they relied heavily on independent contractors and could not afford to hire them as employees or stopped working with independent contractors because of fear of compliance. This was highlighted by interviews of small business owners in the wake of AB5.

April 21, 2023 // Through the PRO Act, DOL rulemaking, and installing those who will do their bidding atop federal government agencies, the establishment Democratic Party, in lockstep with the Big Labor lobby hopes to force tens of millions of Americans out of freelancing and independent contracting and into “employee” status, which would allow the unions to focus on organizing new sectors in the face of dwindling membership. Rep. Kiley has fought against these efforts every step of the way, first in the California State Assembly and now in Congress, and called the hearing to highlight just how destructive the Biden/Su agenda will be to all Americans, and not just Californians, and has called Su “the architect and lead enforcer of AB-5.”
