    Bill Prohibiting Union Time on Taxpayers’ Dime Would Extend Trump EO to Entire Federal Workforce

    April 10, 2025 // With the average federal employee receiving almost $163,000 in total compensation (including $106,400 in pay and $56,600 in benefits), the time federal employees spend working for their union can add up quickly. The House Committee on Oversight and Accountability discovered that 1,030 Social Security Administration employees spent a total of 242,237 hours on official time in fiscal year 2023. This cost taxpayers $15.1 million, including $1.43 million to pay 14 employees who spent 100% of their time working for their union. Meanwhile, senior citizens across the country were struggling to get in touch with Social Security Administration employees and unable to get in-person appointments at their local Social Security Administration offices.

    April 9, 2025 // “Federal government unions are heavily involved in party politics,” National Right to Work Committee President Mark Mix said in a statement. “They stage massive political protests, and contribute large amounts of money and manpower to influence elections. Employees of these unions should not have their salaries paid by American taxpayers.” Lee cited a 2016 report by the Office of Personnel Management that showed federal employees spent 3.6 million hours on union-related businesses, costing taxpayers more than $177 million. That number dropped to 2.6 million hours, costing $134.9 million, during the first Trump administration, according to Lee.

    April 8, 2025 // Lee and Cline’s No Union Time on the Taxpayer’s Dime Act would end the practice of “official time”— paid time given to federal employees to perform union duties during work hours and using government office space. This practice costs taxpayers more than $100 million annually, according to data from the White House Office of Personnel Management (OPM).

Mike Lee (R-Utah) and I recently introduced the Federal Workforce Freedom Act, which would put a stop to all collective bargaining agreements between federal agencies and labor unions. Among its provisions, this legislation would prohibit federal employees from participating in labor unions for the purposes of collective bargaining, ban federal agencies from engaging in collective bargaining negotiations, and immediately terminate all collective bargaining agreements.

    March 18, 2025 // In addition to tracking the number of employees and their time, agencies also have to report on other taxpayer-provided subsidies to unions. That would include, for example, “a single Veterans Affairs facility allocate[ing] half of a hospital wing—over 5,000 square feet—largely for the use of the union president and officials” as exposed in a report from the Institute for the American Worker. The irony of federal employees’ excessive use of official time is that they can’t even bargain for the biggest things most unions bargain over—pay and benefits. And working predominantly in offices (or, prior to Trump’s executive order requiring federal employees to return to the office, in their homes) hardly poses a need for lengthy worker safety negotiations. That leaves official time to be predominantly spent defending poor performers and bad actors that agencies have disciplined or dismissed, and negotiating over tedious things like the height of cubicle panels; designated smoking areas on otherwise smoke-free campuses; and the right to wear spandex at work.

    Lawmakers propose banning all federal labor unions

    March 17, 2025 // “This legislation would end federal labor unions and immediately terminate their collective bargaining agreements to ensure the federal government is working on behalf of the American people – not labor unions – by increasing the productivity of its workforce,” Blackburn said in a statement. If passed, the bill would affect 25% of the federal employee workforce who are members of public sector unions, according to the U.S. Bureau of Labor Statistics.

    January 17, 2025 // The results of the 2024 presidential election were a repudiation of Biden’s “most pro-union administration in American history,” in favor of one that sides with actual workers, as opposed to union bosses. Congress has every right to demand oversight over the expenses of the executive branch, especially when taxpayer dollars are funneled to union bureaucrats that are working in the interests of themselves and not the American people.

    January 17, 2025 // After the last official report was compiled in 2019, the OPM stopped reporting the hours and costs involved in union-related “official time” despite repeated calls from House Education and Workforce Committee Chairwoman Virginia Foxx for President Trump’s 2018 Executive Order to be honored. Pushback continued in 2023 when Sen. Marsha Blackburn (R-Tenn.) directed a letter to the OPM querying why the website reporting page went missing in July of that year, only to be told the site was undergoing “maintenance”. In March of last year, Sen. Joni Ernst (R-Iowa) introduced legislation entitled the Taxpayer-Funded Union Time Transparency Act which called on a return to reporting on the part of the OPM regarding time spent on collective bargaining. In August, Sen. Mike Lee (R-Utah) introduced a bill entitled the No Union Time on the Taxpayer’s Dime Act to curtail union activities by federal employees during work hours. All these attempts to increase transparency for taxpayers were roadblocked by Democrats in Congress and even now, the site still has not re-emerged – making I4AW’s report even more critical.

    August 5, 2024 // Although the Trump-Pence administration tried to rein in official time—limiting it to no more than 25% of employees’ time—the Biden-Harris administration reversed those reforms. Taxpayers presumably once again pay some employees to spend 100% of their time working for their unions. I say presumably because the Biden-Harris administration removed the Office of Personnel Management’s webpage on official time, which had provided transparency for more than a decade on how many federal employees did work for their union instead of for taxpayers, and how much time they spent doing it. Although we no longer know how many federal employees use official time, or how much total time they’re using, the disappearing webpage doesn’t indicate that official time has declined.

    Ranking Member Cassidy, Kiley Introduce CRA to Overturn New Biden Regulation Threatening 27 Million American Independent Contractors

    March 6, 2024 // Independent contractors, or freelancers, make their own hours to fit their schedule and decide where and how they want to work. The Biden administration rule attempts to restrict the ability of American workers to be an independent contractor and take advantage of the flexibility it provides. The rule creates a non-exhaustive, six-factor litmus test for unelected bureaucrats to interpret and decide who is and who is not classified as an independent contractor. It also casts as large a net as possible and gives less legal certainty to independent contractors impacted by the regulation. “The Biden administration’s priority should not be to do whatever makes it easier to forcibly and coercively unionize workers. It should be to increase individual freedom and opportunity,” said Dr. Cassidy. “This new Biden rule does the opposite, jeopardizing 27 million workers’ ability to make their own hours and make a living without being pressured into joining a union.”
