NLRB puts union bull’s-eye on the franchise industry
January 2, 2023 // The National Labor Relations Board has proposed a dramatic overhaul of the franchise business model by reclassifying workers at restaurant or hotel chains as employees of the parent company, a move that would make it easier to unionize across the entire brand. Opponents warn that the change will devastate an industry employing 8.2 million people and contributing roughly 7% to the nation’s overall economic output. “This is going to hurt a lot of people, from someone coming out of the corporate environment looking to be an independent business owner to someone looking to start their career with an entry-level job to consumers who will have to pay $15 for a hamburger,” said Frank Caperino, who teaches franchise management at San Diego State University and owns multiple franchises.

Gray received free legal aid from National Right to Work Legal Defense Foundation staff attorneys.
Spanish Broadcasting System Radio Host Appeals Case After Labor Board Blocks Vote to Remove SAG-AFTRA Union Officials
December 20, 2022 // With free legal aid from the National Right to Work Legal Defense Foundation, Spanish Broadcasting System radio host Adal Loreto is defending his and his coworkers’ right to vote unwanted Stage Actors’ Guild (SAG-AFTRA) union officials out of their workplace. In July, Loreto filed a petition for a group of his coworkers seeking a vote to end union officials’ so-called “representation” over on-air talent of KLAXFM and KXOL-FM radio stations. That National Labor Relations Board (NLRB) decertification petition resulted in a mail ballot election conducted in August and September. However, the workers’ ballots were never actually counted. Now, Loreto and his National Right to Work Foundation staff attorneys have filed a Request for Review at the National Labor Relations Board in Washington, DC, asking the Board to overturn NLRB Region 31 Director Mori Rubin’s order that the workers’ ballots be destroyed and never counted.
Labor Board Backs USC College Athletes in Case, Arguing They Are ‘Employees’ Who Should Be Paid and Permitted To Unionize
December 20, 2022 // The National Labor Relations Board (NLRB) will take the side of student athletes in an unfair labor practices case against USC, the Pac-12 Conference, and the National College Athletics Association (NCAA). If a judge sides with the NLRB, it could mean that student athletes across the nation will be reclassified as “employees” of their respective schools who are entitled not only to compensation, but to other employee benefits such as the right to unionize.
Yale Union Election Is Latest Move in Campus Labor Renaissance
December 5, 2022 // Unite Here Local 33 previously won a set of elections to represent several Yale academic departments as separate bargaining units before pulling the petitions to avoid the Trump board ruling on the university’s appeal. The union was able to move quickly to an election following the flip of partisan control at the NLRB. The in-person voting will take place a little over a month after the union filed its Oct. 24 representation petition.
Judge tells Amazon: Stop retaliating against employees
December 1, 2022 // According to the decision, the NLRB's argument was that failing to rehire the terminated employee would result in a weakening of the ALU's ability to organize. There wasn't any evidence presented to indicate that, the judge said, adding that the employee "was terminated approximately one year before the ALU was formed." Per the judge, that means this case is distinguishable from similar ones in which reinstatement would be justified. JFK8 employees voted to join the ALU in April 2022, not long after the ALU petitioned the NLRB for the right to hold a union election. Another vote to organize a second Staten Island warehouse in May of this year failed to pass, which led the NLRB to file another complaint against Amazon in September alleging unfair treatment of union organizers. The NLRB alleges the treatment may have affected the vote, and the case is still ongoing.
Dates set for Ultium Cells to vote to join UAW
November 28, 2022 // Dates have been set for workers at Ultium Cells in Lordstown to vote to join the United Auto Workers (UAW) union. This voting comes after months of efforts from Ultium Cells workers to unionize. In August, 85% of Ultium Cells workers signed union authorization cards. 94% of workers have voted to strike should General Motors not recognize them as a union.

He is receiving free legal aid from National Right to Work Foundation staff attorneys.
