Board Overturns ALJ Determination That Starbucks Threatened Worker
August 6, 2026 // The Board majority reversed an administrative law judge and dismissed a complaint alleging that Starbucks unlawfully threatened employees over their ability to pick up shifts at other stores based on union status. Starbucks employees are typically scheduled for fewer than 40 hours a week at their assigned “home store” and routinely “borrow” shifts at other locations to make up hours. In January 2022 the company rolled out an online tool called Shift Marketplace to facilitate this borrowing, and none of the training materials or guides limited borrowing based on whether an employee’s home store was unionized.

The workers’ effort was spearheaded by Lionel Powell, who filed a petition with the National Labor Relations Board (NLRB), seeking a “decertification” election to end the Teamsters’ monopoly bargaining control over the workers. Powell’s petition was filed with free legal aid from the National Right to Work Foundation.
Federal Court Permanently Enjoins New York State’s Effort to Replace the NLRB
August 5, 2026 // The Court also noted that the NLRB regained a quorum less than one month after the preliminary injunction was issued, thus restoring the Board’s ability to function and undermining the defendant’s argument that the inoperability of the NLRB required expanded state jurisdiction. Accordingly, the Court granted summary judgment in Amazon’s favor, declared the SERA Amendment unconstitutional, and permanently enjoined its enforcement. The Court then dismissed the remaining claims as unnecessary in light of that relief. Shortly thereafter, the NLRB and New York State stipulated to the dismissal of their parallel litigation in the Northern District.

Days later, ahead of that year's Big Ten Media Days, an independent news outlet incorrectly reported that Penn State players were unionizing.
