Labor Department would ignore law to change overtime rules
November 16, 2023 // The DOL’s preamble to its proposals repeats as if a mantra its reliance upon “the authority that the FLSA grants to the Secretary to define and delimit the EAP exemption.” But in its repetitions of the define-and-delimit mantra, the DOL omits the part where the FLSA says the terms of the exemption are to be defined and delimited “by regulations of the Secretary, subject to the provisions of subchapter II of chapter 5 of Title 5.” Those provisions, known as the Administrative Procedure Act, require regulations to be adopted through a procedure that gives the public a chance to submit comments on a proposed regulation and requires the agency to respond to significant comments. The DOL proposal to make future increases in the salary levels automatic violates the Administrative Procedure Act’s requirements.

The negotiating committee did say that the company agreed to “some significant changes” since the strike began but that members would be voting on the same contract that was voted down in early October. The letter said that the negotiations were over and the contract would come up for a vote. Most notably, the letter warned of the repercussions of voting down the contract, which included possible lost of jobs, loss of insurance after Dec. 1 and a loss of a $3,500 ratification bonus.

November 7, 2023 // Union members told FOX13 the company wants to take away 30-minute paid breaks, requiring workers to clock out during their break. Changes are also expected in overtime pay. According to BCTGM International Representative Darrell Copeland, the company proposed removing 8-hour overtime pay. New contract terms would only allow workers to get overtime after they’ve reached 40-hours.
‘Battle royale’: Tesla and anti-union Musk make enticing targets for UAW’s next push
November 5, 2023 // Some current UAW members are already fired up to take on Tesla. “Go out west to California? Absolutely, I would go,” said John Jake Kincaid, a Stellantis employee in Michigan. “Show them our strength.” Still, fighting for a contract at companies with established relationships with union workers is a far different effort than starting from scratch. Several workers who were key to Tesla’s earlier union effort are no longer at the company. The Fremont plant’s history with the UAW predates the electric vehicle maker. For about 25 years, Toyota and GM operated the facility together in an unusual joint venture. It was a union shop. In 2009, GM pulled out of the partnership as part of its bankruptcy proceedings and in 2010 Toyota shut the operation down, throwing 4,700 people out of work. A month later, Tesla bought the sprawling 5.3 million square foot factory; the union didn’t come with the purchase.

Workers at Mack Trucks set to strike after rejecting tentative contract deal
October 9, 2023 // Union workers at Mack Trucks have voted down a tentative five-year contract agreement reached with the company and plan to strike at 7 a.m. Monday, the United Auto Workers union says. Union President Shawn Fain said in a letter to Mack parent company Volvo Trucks that 73% of workers voted against the deal in results counted on Sunday. The UAW represents about 4,000 Mack workers in three states. Union leaders had reached a tentative agreement on the deal on Oct. 1. The deal included a 19% pay raise over the life of the contract with 10% upon ratification. There also was a $3,500 ratification bonus, no increase in weekly health care contributions, increased annual lump sum payments for retirees and a $1,000 annual 401(k) lump sum to offset health care costs for employees who don’t get health insurance after retirement. Fain said in his letter to Volvo Trucks’ head of labor relations that employees working early Monday will exit the factories after performing tasks needed to prevent damage to company equipment.

Auto suppliers say if UAW strikes expand to more plants, it could mean the end for many

So if the strike expands to other automaker plants and lasts into weeks, the job layoffs could reach into tens of thousands. "You have the direct employment and you have the multiplier affect of each of the automotive jobs and that is between six to 10 people for every one automaker job, so it’s substantial," Stevens said. "This is the largest industry in our economy. It has an economic contribution of over $300 billion annually to the state of Michigan.

Former president of Wilmington construction company pleads guilty to payroll scheme
September 12, 2023 // Acting U.S. Attorney Joshua Levy’s office said Frank Loconte, 62, of Beverly, defrauded union workers of more than $1 million of overtime work and the IRS of more than $3 million by not making the required payroll tax and union dues withholdings and payments. Documents filed in federal court state Loconte used the funds for personal expenses, including vehicles, household improvements, golf club memberships, and personal property taxes for houses in Beverly, Ipswich and Andover, as well as Naples, Florida. Loconte, who served as the president of NER from 2009 to 2022, pleaded guilty on Wednesday to mail fraud and failing to pay taxes, which are charges that carry a combined sentence of up to 25 years in prison.

Biden administration working overtime to regulate working overtime
September 5, 2023 // ederal law says employees must be paid time and a half once they work more than 40 hours in a week. However, businesses may exempt workers from the requirement if their duties are “managerial” in nature and they reach a certain salary threshold. Currently, workers had to earn at least $35,500 annually before they were covered. The new rule, which goes into effect at the end of the year, raises that by almost $20,000. The administration estimates this would extend the rule to 3.6 million additional workers. The problem with the change is that it limits employers’ ability to work out alternate arrangements with employees where they work more than 40 hours in exchange for some other consideration, such as additional time off on other weeks. Under the new rule, employers are more likely to simply cut hours than to have to pay overtime at all.
