July 24, 2025 // In 2024 alone, the DOL recorded 177 union enforcement actions involving fraud, embezzlement, wire fraud, and falsified records. These are only the crimes that rise to the level of federal prosecution. Far more ethical violations, financial misuses, and questionable behaviors fall below the radar leaving union members in the dark and are quietly buried through internal repayments, hush resignations, or legal threats — all without any formal DOL investigation or public accountability. Despite 16 years as a union official, I did not become aware of the existence of LM-2 financial disclosure filings until our local filed a lawsuit against our state affiliate. Imagine that: even as a union president and past treasurer, I was unaware that both our state and national unions were required to submit LM-2 forms to the Department of Labor. If someone like me — deeply engaged in union governance — was kept in the dark, how can we expect average members to know their rights, much less exercise them?
Fenway, MGM concession workers vote to authorize strike

Lambeau Field workers win first union contract
November 7, 2024 // The beer vendors are employed by Delaware North, the food and beverage provider for the stadium. The Milwaukee Area Service & Hospitality Workers Union, or MASH, represents more than 90 people who serve beer and other beverages at Lambeau. The union said 88 percent of the vendors voted to approve a tentative three-year collective bargaining agreement that was negotiated with Delaware North.

It also means many small mom-and-pop businesses like plumbing, baking, accounting and cleaning can’t perform mutually beneficial services for other businesses without being slammed by costly new regulations, legal threats and even targeted unionization efforts — not to mention the loss of their American Dream to have an independent business in the first place. In other words, more than 750,000 franchises and even more small businesses serving as contractors and vendors are now under threat, as are tens of millions of workers. The similar 2015 Browning-Ferris joint employer rule was estimated to increase costs by more than $33 billion and lead to 376,000 lost jobs for franchises, meaning the new rule in 2024 will be even more costly. Next, on January 10, the Labor Department published a final independent contractor rule that modifies the subfactors used in Labor’s “economic realities” test to create as many roadblocks toward independent contractor careers as Labor can without legislation.

NLRB’S RADICAL JOINT EMPLOYER STANDARD WILL DESTROY SMALL BUSINESS AND THE AMERICAN DREAM
October 11, 2022 // The NLRB is pursuing a new joint employer rulemaking that has the potential to destroy small businesses, the American Dream, and the economy. Under this expanded standard, nearly every contractual relationship between businesses will trigger joint employer status, making businesses responsible and liable for the employment practices of their franchisees, suppliers, vendors, contractors, and subcontractors. Under this new rule, businesses will be forced to protect themselves against significantly more liability and obligations under the law. The franchise business model, for example, would be gutted, as the larger franchisor will move to end or limit their support to franchisees or exert increased authority over them, essentially turning those small business owners into employees. The new standard would also force larger companies to subsume local small businesses rather than work with individually owned enterprises, stifling entrepreneurship, business innovation, and flexibility. The expanded standard even hampers businesses’ efforts to encourage “corporate responsibility” among their business partners to the detriment of workers, consumers, and their communities.
