If workers want a union, and employers use illegal tactics in the run-up to a union election that could compromise the election — like firing union organizers, or retaliating against workers engaging in protected union activities — the new rules says workers no longer have to hold a fresh election. Workers will instead automatically get their union and employers will have to bargain with them.

    The PRO Act is wrong for Pennsylvania

The Employee Rights Act–also introduced this year–would empower workers and bolster the small business community. Among provisions, the bill would guarantee that any vote to form a union would be done via secret ballot election, protect the autonomy of self-employed Americans, and preserve the franchise small business model.

Phil Murphy, whose administration took the fight to the U.S. Supreme Court, and his allies in the International Longshoremen’s Association, the maritime labor union that has controlled hiring at the port for decades. In late July, Murphy traveled to the union’s international convention in Hollywood, Fl. to celebrate the victory and salute the man he calls a “dear friend” and “partner in growing the New Jersey economy,” ILA President Harold J. Daggett. “I am happy to report that as of last Monday, the commission has been officially dissolved,” said Murphy, addressing more than 1,000 cheering union members assembled in the grand ballroom of The Diplomat Beach Resort. “Now we can finally begin to turn the page, and together, I look forward to starting a new chapter at our ports.” Murphy’s speech came a day after a profanity-laced address by Daggett, who promised a “painful” comeuppance for union foes and companies that would attempt to replace workers with automation. He vowed to cripple port commerce next year if the union’s contract demands aren’t met. “Mark my words! There’s going to be an explosion,” Daggett said. “Someone must take the bull by the horns, and that’s me… Don’t f–k with the maritime unions around the world. We will shut you down!”

    Wabtec sues union, seeks injunction aimed at conduct of striking workers on picket line

    August 3, 2023 // Since the United Electrical, Radio and Machine Workers of America went on strike on June 22, according to Wabtec's motion, the striking workers have, among other things, used racist and homophobic slurs against non-striking employees entering and leaving the plant, damaged employees' personal vehicles, blocked the plant's gates and subjected the plant to two phoned-in bomb threats. Wabtec sued the UE in asking for the injunction. "Wabtec has made consistent efforts to address the Union's unlawful and dangerous picket activity with the Union and its counsel, but the activity has persisted and most recently escalated, amounting to an unlawful seizure of the Wabtec facility," according to Wabtec's motion.

    ESG Is a Front for Labor

    July 24, 2023 // House Republicans have declared July “ESG month,” planning hearings and bills to push back against politicized environmental, social, and governance investing. Yet so far, lawmakers have almost exclusively focused on environmental issues. Republicans should also pay attention to the “S” in ESG, which labor unions are using to advance their agenda at the expense of workers, their own members, and even taxpayers — a problem that President Biden has significantly worsened. The 2023 proxy season, which started in January and ended in June, shows the union campaign in action. Union funds and their allies, such as the New York City Employees’ Retirement System and like-minded investment managers, introduced many ESG-focused shareholder proposals designed to accelerate unionization. Consider Apple, which was targeted by five New York City pension funds, multiple investment managers, and the SEIU Master Trust Pension Plan, among others.
