    Facing Decertification Vote, UAW Quickly Settles Contract At NJ Nissan Facility

    April 20, 2024 // If the election moves forward, and the majority of employees decide to keep the UAW, through their attorneys at the National Right to Work Legal Defense Foundation, it would seem that the employees opposed to union representation could object to the company and union settling a contract as interfering with their right to ‘free and fair’ election. However, if employees do object, given the pro-union nature of the current National Labor Relations Board, it remains a question whether election interference by a union would constitute grounds for setting aside the election.

    April 19, 2024 // Like the prior comission, it will continue to conduct critical investigations into organized crime in the Port of New York, as well as ensure fair hiring practices that bar discrimination. It will conduct background checks and license companies and people working in the cargo business at the port. The commission will have the power to oust employees from the workforce who are found to have engaged in serious criminality and other violations.

    April 18, 2024 // The DOL issued a rule creating a very strict and confusing definition of a 1099 worker which will certainly have a chilling effect on the entrepreneurial environment and the opportunities available to freelancers. A similar bill was passed in California (AB5) and it devastated small businesses and freelancers. Pacific Legal Foundation is now representing Kim and other plaintiffs in a lawsuit against the DOL. I want to thank Congressman Tom Kean Jr. for sponsoring action on behalf of the New Jersey delegation to push back against this intrusive and egregious assault on independent contractors.

    April 16, 2024 // .A California-based tutoring company provides one anecdotal example of the consequences. The company has already let go independent workers in the Golden State and—in anticipation of the nationwide DOL rule—has announced terminations in Massachusetts and New Jersey. It’s the proverbial canary in the coal mine. If Congress doesn’t act, the DOL’s rule risks replicating California’s dysfunction on a national scale. One estimate predicts the independent workers impacted by this rule could face more than $30 billion in lost income. That tracks with a recent Mercatus Center study on the impact of AB 5 in California. It found that after the law was implemented, self-employment decreased by more than 10 percent on average for affected occupations. Overall employment decreased by more than four percent.

    April 12, 2024 // According to the unionization committee at Apple Short Hills in New Jersey, the group has asked Apple not to interfere in the efforts and to allow employees “to freely determine for themselves whether to form a union.” Apple responded by saying that it’s “dedicated to providing an excellent experience” for its customers and teams.

    Somerset, NJ, Nissan Parts Distribution Center Employees File Petition for Vote to Kick Out UAW Union

    April 5, 2024 // Michael Oliver, an employee of Nissan North America’s parts distribution center in Somerset, NJ, has just filed a petition with the National Labor Relations Board (NLRB) seeking a workplace vote to remove United Auto Workers (UAW) officials from his workplace. Oliver filed the petition with free legal aid from the National Right to Work Legal Defense Foundation.

    Over 1,000 nurses at Staten Island University Hospital submit strike notice

    March 25, 2024 // This strike notice follows several other nurses strikes across the Tri-State Area. Nurses at Robert Wood University Hospital in New Jersey were on strike for nearly four months last year before ratifying a new contract in December. A possible strike was averted at Long Island Jewish Valley Stream Northwell in February.

    The Medieval Times Union Campaign Is Over

    March 14, 2024 // Workers at the California castle went on an unfair labor practice strike last February, saying the company was refusing to bargain in good faith. The strike was meant to pressure Medieval Times into reaching a contract. The company flew in replacement knights — “scabs,” in union parlance — to fill in for those who’d walked off. Zapcic said it was hurtful to watch so many customers — including one she remembers with his union logo tattooed on his neck — crossing their picket line each night.
