Gavin Newsom Wants to Curb a Labor Law That Cost Businesses $10 Billion
June 12, 2024 // Newsom’s office has brought together the state’s powerful California Chamber of Commerce with the California Labor Federation to hash out a compromise over the Private Attorneys General Act, or PAGA, people familiar with the negotiations said. The law has cost big and small businesses $10 billion over the past ten years, according to one study, and is viewed by labor advocates as a model of worker protection.The negotiators are in a race against time: June 27 is the deadline to strike a measure from Californians’ November ballot that would give voters the opportunity to repeal the law. The Chamber of Commerce is negotiating on behalf of a broad alliance, which includes the billionaire owner of the Wonderful Company, Stewart Resnick, car dealership owners, Walmart and McDonald’s Corp., along with small businesses across the state. The business coalition committed more than $31 million to entities backing the ballot measure, including the signature-gathering effort and an advertising blitz.
Biden’s veto of joint employer rule CRA a blow to small businesses
May 5, 2024 // Those franchisor corporations will not want to be on the hook for potential violations. They’ll either limit how they franchise and/or assert more control over their franchisees. Either way the entrepreneurs that ran them will lose out. A court blocked the rule from taking effect in March, saying that the NLRB had exceeded its authority. The board is expected to appeal the ruling.
Opinion: Gambling With a Worker’s Job
May 1, 2024 // But the job losses go beyond anecdotal evidence. In our recent analysis of California’s AB5, which is the first empirical investigation of the law, my co-authors and I find that it is associated with a significant decline in overall employment and self-employment for affected occupations. Self-employment fell by 10.5 percent for non-exempt occupations. Overall employment fell by 4.4 percent in the same professions. Not only that, but AB5 didn’t appear to make up for these job losses by putting more employees on traditional payrolls with better stability, benefits or protections. Our study found no consistent evidence of more workers becoming W-2 employees.

April 18, 2024 // The DOL issued a rule creating a very strict and confusing definition of a 1099 worker which will certainly have a chilling effect on the entrepreneurial environment and the opportunities available to freelancers. A similar bill was passed in California (AB5) and it devastated small businesses and freelancers. Pacific Legal Foundation is now representing Kim and other plaintiffs in a lawsuit against the DOL. I want to thank Congressman Tom Kean Jr. for sponsoring action on behalf of the New Jersey delegation to push back against this intrusive and egregious assault on independent contractors.

Or rather, they consider the reward of the contract work and compensation to be greater than the risk of not having the traditional protections a full-time employee might enjoy. Many contract workers also work full-time jobs that offer said protections. The gig economy has exploded in the last two decades. Before the pandemic, it was estimated to employ 36 percent of American workers, or about 57.2 million people. Statistics from last year suggest there are over 73 million freelancers in the U.S.
