‘Independent Contractor’ Rule Latest Dumpster Fire Exported From California
January 31, 2024 // One of those infamous policies and the havoc it’s bound to wreak has gone national, thanks to labor department rules issued by the Biden administration. A 339-page Department of Labor rule – you can always count on the federal government to keep it pithy – would make it much harder to be an independent contractor or freelance worker in America. Created to replace a simpler Trump-era rule, it’s modeled on AB5, a disastrous 2019 California law that made independent contracting and freelance work so hard to do that it effectively outlawed it in the Golden State.

January 29, 2024 // “The Bureau of Labor Statistics reported an increase in union membership, with 139,000 more union members in 2023 than in 2022, meaning this country has 400,000 more union workers than we had in 2021. The gains under the Biden-Harris administration underscore President Biden’s commitment to being the most pro-worker, pro-union president in history. “We have seen large private sector increases in unionization among health care workers, transportation and warehousing workers, and in educational services. These are workers who recognize that they have power and are organizing to use that power. Workers in health care, auto manufacturing, transportation, entertainment and more have delivered big wins at the bargaining table in the past year.

January 22, 2024 // AB 5 offers a warning to the nation. It is one reason California has ranked first or second in the country when it comes to unemployment and poverty, and last in the country in wage growth. Congress must reject the nationalization of AB 5 and protect the diverse range of work arrangements that contribute to the American economy. We must oppose the ongoing attacks on worker freedom and ensure that worker preferences and autonomy are accounted for in all policy decisions. More than ever, we must support the right of enterprising Americans to pursue their calling as they see fit. To that end, I am introducing legislation to nullify Biden’s Independent Contractor rule, and urge all Members of Congress to support it.

January 22, 2024 // Biden promised to be the “most pro-union president you’ve ever seen,” so he needs to reward all those campaign donations. And Biden’s doing it regardless of the impact on the economy. Independent contractors cannot be unionized, so the more companies lean on these workers, the less ability unions have to organize. It’s really that simple. The Biden administration is trying to sell its new rule as a way to protect workers and make it easier for them to qualify for benefits such as overtime pay and paid time off.

January 18, 2024 // If approved, Su won’t be the only half-baked Californian in the Biden White House. Vice President Kamala Harris is (per National Review’s Charlie Cooke) “talented enough to make the inanities uttered by her rival Pete Buttigieg sound substantive, concise, and apprehensible.” Economist David Bahnsen calls California’s Janet Yellen “a career bureaucrat, albeit a hyper-intelligent one, who has spent an adult life devoid of accountability for poor decisions and even poorer ideas.” California’s Xavier Becerra knew nothing about health or human services until Biden made him head of Health and Human Services; during Covid, he did nothing, which, given his résumé, might have been for the best. Becerra’s fathomless ignorance is almost a prerequisite for this administration, where experience might mean owning your failures. The first White House gig of Californian Alejandro Mayorkas, now secretary of homeland security, as Obama’s director of U.S. Citizenship and Immigration Services involved running interference for a scandal-plagued electric-car company run by Secretary of State Hillary Clinton’s brother Tony Rodham and Terry McAuliffe, cochairman of President Bill Clinton’s 1996 reelection campaign, chairman of the Democratic National Committee from 2001 to 2005, and chairman of Hillary Clinton’s 2008 presidential campaign. I needn’t go on — or should I mention that Biden’s deputy secretary of education is a former San Diego teachers’-union official whose concern for union power exceeds any attachment to student performance? While she was Governor Gavin Newsom’s secretary of labor, Su oversaw the implementation of bad policy and the mismanagement of simple procedures. Any one of her major catastrophes would have been career-enders elsewhere; in California, where the failure of progressive policy is invariably a prompt for more progressive policy, she was instead excused — and then promoted into the Biden
Trucking groups slam DOL’s new worker classification rule as ‘un-American’
January 10, 2024 // The coordinated release of this rule with the renomination of Julie Su to lead the Department of Labor is proof positive that the Administration is doubling down on destructive policies that eliminate choice and opportunity for our workforce. Had Su actually taken the time to talk to independent contractors, she’d know firsthand what a misguided rule this really is. That is exactly why we opposed her nomination before and why we will continue to oppose it now. Radical California agendas have no place in federal policy.” Spear vowed that the ATA “will work with members of Congress and other stakeholders to defeat this ill-advised rule.” In a statement, the Intermodal Association of North America (IANA) called the new requirements “burdensome,” adding that they “significantly limit the use of independent contractors in the trucking industry and threaten to force the reclassification of over 80 percent of intermodal drayage drivers that currently enjoy independent contractor status.”

January 10, 2024 // The Culinary Local 226 and Bartenders Local 165 represent 60,000 workers in Las Vegas and Reno and help keep the Silver State’s casinos running. The union, majority female and Latino, is also a political powerhouse that mobilizes its members to vote. It historically delivered Democratic victories in the battleground state through door knocking and get-out-the-vote drives. U.S. Rep. Steven Horsford, D-Nev., who had led the Culinary Training Academy, credited the union Wednesday with electing him to Congress.
The Biden Administration’s Anti-Worker Policies Set to Fail Again
December 28, 2023 // “Conservatives in Congress are holding the line against President Biden’s desire to make California labor policies a standard for the entire Nation. This latest rejection of President Biden’s pick for labor secretary is another reminder to President Biden that restrictive contracting laws, high minimum wage requirements, and excessive regulations on small businesses do not put American workers first. These disastrous, anti-worker policies are why people are leaving California in droves, and we should not export them to the entire country.”
Senate left without voting to confirm Julie Su as labor secretary. She’ll stay on the job though.
December 26, 2023 // “We are going to be very clear — Julie Su will be renominated (as) Secretary of Labor in the new year. That is something that we are committed to,” said White House spokeswoman Karine Jean-Pierre. Sen. Bill Cassidy, top Republican on the committee that would first have to approve the nomination, remained opposed to Su as secretary. Democrats have a committee majority, and control 51 Senate votes, but have been unable to get enough votes to formally confirm Su. Cassidy, R-La., said in a statement last week that “We need a qualified Secretary of Labor who can impartially enforce the law, properly manage a department, and refrain from partisan activism. Ms. Su failed to show her ability to do any of those three thing “It is clear Ms. Su lacks the necessary votes for confirmation. I urge President Biden to put forward a nominee who is committed to fair enforcement of our nation’s labor laws and is capable of being confirmed in the Senate.”
Biden’s labor proxy war against DeSantis
November 22, 2023 // Su is abusing her discretionary power under the Federal Transit Act. Yet if her actions are allowed to stand, labor unions may come to regret it. Future administrations may interpret the “fair and equitable” provision to require that states enact policies like Florida’s. States such as California, New York, and Illinois may suddenly find themselves out billions of dollars unless they stop giving unions unfair advantages and start protecting public-sector workers’ rights. Those states would surely argue that the Federal Transit Act doesn’t grant the secretary of labor such sweeping authority, but if that’s true, then the Biden administration’s assault on Florida is equally wrong.
