Delaney is arguing that NNOC union officials are violating the “duty of fair representation,” a legal mandate that requires union officials not to discriminate in its bargaining functions, including on the basis of union membership. The duty originates from a 1944 Supreme Court case, Steele v. Louisville & Nashville Railway Co., in which the Court recognized that rail union bosses were manipulating their powers over the workplace to discriminate against African-American railway workers.

About 20,000 employees represented by the University Professional and Technical Employees (UPTE) and nearly 40,000 workers with the American Federation of State, County and Municipal Employees began their strike around 7 a.m. UC Berkeley, UCSF, the Lawrence Berkeley National Laboratory were among the Bay Area locations where workers were striking.

Even after its closure yesterday, union workers protested in front of the restaurant past 6 p.m. Unite Here, which represents the workers, filed an unfair labor practice charge with the National Labor Relations Board on February 7 with allegations that the closure violates federal labor law. On February 25, the NLRB dismissed the charge due to “lack of cooperation from the Charging Party.” The union can still appeal the decision. Back in April 2023, a few weeks before Riordan died, a class-action lawsuit alleging unpaid overtime, rest, and meal breaks was filed on behalf of workers; the case remained in settlement talks as of February 2025.

February 11, 2025 // The City of Milwaukee’s street car system, called The Hop, is operated by TransDev, a French multinational transportation company. In November, a majority of 26 TransDev employees working out of the city’s streetcar facility at 450 N. 5th St. voted in favor of representation by ATU Local 998, according to National Labor Relations Board records. The union includes operators, maintenance workers, road supervisors, operator supervisors and dispatchers.
