Unions have an incentive to allege illegal activity regardless of whether it happened, and under the Biden administration, the NLRB is much more inclined to agree with unions. The Cemex decision itself is proof of the board’s union bias. The NLRB is run by people appointed by the self-described “most pro-union president ever.” Lo and behold, they make pro-union decisions. The Alabama autoworkers should be terrified. They couldn’t have been clearer in their rejection of the UAW.

June 4, 2024 // While Biden aims to cast himself as “the most pro-union president in American history” and shores up protections for science within agencies, government employees using collective bargaining to thwart a potential Trump administration is unprecedented and could act as a blueprint for other unions to follow suit. AFGE’s new deal also comes after the Biden administration finalized a rule in April to cement protections for civil servants, as Trump has flirted with the idea of returning to his Schedule F policy that would allow him to easily fire or reclassify government workers. The agreement would not be able to prevent a Republican-aligned EPA from enacting policy, but Cantello anticipates the agency could appeal to the Federal Labor Relations Authority if an arbitrator ruled in favor of the union.

Businesses blast new Biden rule allowing union reps to inspect job sites
May 23, 2024 // The National Federation of Independent Businesses, along with the U.S. Chamber of Commerce and other business groups, are helping lead the charge against the new “walkaround” rule, which takes effect May 31 of this year. “Small businesses want to create a safe work environment for their employees, and they understand the necessity of reasonable mandates and inspections to this end,” Beth Milito, executive director of NFIB’s Small Business Legal Center, said in a statement. “But the final rule issued by OSHA goes beyond ‘reasonable’. This rule will allow unlimited third-party individuals to initiate and then join an inspection of a private workplace under the guise of representing the employees. Not only does this violate a small business owner’s private property rights, it will not advance worker safety. It only makes small businesses susceptible to harassment from competitors, union representatives, and other parties intending to cause harm.”

For that, my colleague Liya Palagashvili suggests ending the exclusive-representation clause that "provides government-granted monopoly status to a union supported by 51 percent of an employer's workers, giving it the sole authority to negotiate. This means that if some workers want a different union—for example a newer one that might raise the bar in terms of what it can offer—they are out of luck." Today, these workers aren't allowed to engage in any negotiations with their employers, and they still have to pay the original union's fees.

May 9, 2024 // What’s more offensive — and, for that matter, illegal? An employee calling a coworker a “gutter b****” and a “queen of the slums”? Or a CEO saying that bringing in a labor union will make the workplace “much slower” and “more bureaucratic”? The answer is clearly the employee who racially and sexually demeaned his coworker. Yet in President Joe Biden’s administration, the CEO is the one getting punished. On May 1, a National Labor Relations Board judge ruled that Amazon CEO Andy Jassy violated federal labor law when he said that unionization comes with downsides.

Commentary: Biden sacrifices workplace free speech to satisfy labor unions
May 8, 2024 // This attack on workplace speech is part and parcel of Mr. Biden’s ultimate goal — legalizing union harassment of workers. Mr. Biden reiterated his support for the Protecting the Right to Organize Act in his State of the Union address, legislation that would rewrite U.S. labor law to the unions’ benefit. One little-known PRO Act provision would force employers to hand over sensitive employee contact information — including phone numbers, email addresses, home addresses and shift times — to union bosses during organizing drives. If the act became legal, workers on the fence about unionization could get a 3 a.m. knock on the door from organizers attempting to “help” them make up their minds. Mr. Biden’s devotion to labor unions has come at a significant cost — the chilling of workplace speech. If Democrats are serious about being pro-worker, they should stand up and oppose Mr. Biden’s anti-speech crusade. But as long as labor unions continue to spend billions to elect Democrats, don’t hold your breath.

A few months later, Vox media layed off hundreds of freelancers. “They expected that all these companies were going to reclassify independent contractors as employees,” freelance musician Ari Herstand told me. “In reality, they’re just letting them go!” Herstand was dismayed to learn that when he wants other musicians to join him, he could no longer just write them a check. “I have to put that drummer on payroll, W2 him, get workers’ comp insurance, unemployment insurance, payroll taxes!” he complains. “I have to hire a payroll company.”

How much time do federal bureaucrats spend working for unions?
April 6, 2024 // As an example of how the administration was already pursuing such policies, the report boasted of how Biden had “restored” official time at the Department of Veterans Affairs. The upshot: The more than 400 medical staff Trump had returned to their actual federal jobs could once again spend their workday on union activism rather than caring for the nation’s veterans. In a March 2023 update, the task force “proudly announced” the unionization of 80,000 more federal employees, purportedly due to the administration’s pro-union strategies. And earlier this month, Biden issued still another order directing federal agencies to establish “labor-management forums” at which agency leaders will engage in “pre-decisional” consultation with union officials over “workplace matters” and discuss how to “promote satisfactory labor relations.”

Biden administration defends decision to nix union accountability effort
March 29, 2024 // Now, in its letter to lawmakers, OPM points out it has moved the official time data to an “agency reports” webpage. However, the last official time report on the site is from fiscal year 2019, meaning none have been completed since Biden took office. No other official time reports are listed on the OPM reports page. “Most tellingly, Director [Kiran] Ahuja offered no apology for the removal of the official time webpage, made no commitment to restoring it, and declined to commit OPM to producing any additional estimates of taxpayer-funded union time use and costs in the future…” Maxford Nelsen, a labor policy expert at the Freedom Foundation, told The Center Square.
