How YIMBYs won over unions in California
August 22, 2023 // The Trades acknowledges there’s a shortage of workers for California’s needed residential construction, and they know their existing unionized workforce is getting older. A union-backed study from 2019 stipulated that to meet the state’s affordable housing goals, California would need to recruit at least 200,000 new workers. But the Trades insist things are not so dire yet that leaders need to abandon “skilled and trained” requirements, and they say more people will be incentivized to become “skilled and trained” only if lawmakers guarantee good union jobs waiting on the other end of an apprenticeship. About 70,500 people have graduated from these apprenticeships between 2010 and 2022, according to the California Department of Industrial Relations. In the end, California lawmakers didn’t really have to make a choice, and ended up passing Wicks’ bill, along with another similar bill that included the Trades’ preferred “skilled and trained” language. For now, developers basically can choose which law they want to follow if they want to convert strip malls to housing. (Yes, really.) “AB2011 was a huge victory, but they allowed the building trades to save face by passing both bills,” said David, the YIMBY activist.
California’s on the cusp of transforming America’s fast food industry — again
August 16, 2023 // “Because it’s so many stores, and going store to store would be difficult, the path to unionization here is basically through legislation,” said Brandon Dawkins, SEIU 1021 vice president of organizing. “After we get the council together and force the employer to the table, then the unions — we can come in and really sit down and negotiate with the corporations to, number one, create a union and, number two, address issues like safety and wage theft.” A labor council’s purview extends to workplace conditions like predictable scheduling — a longstanding goal for labor — noted California Labor Federation Executive Officer Lorena Gonzalez, a former state lawmaker who carried an earlier version of the bill when she served in the state Assembly. “If you get joint employer liability, it’s more likely McDonald’s would want to talk about a national agreement or strategy because now they’re on the hook for every labor violation,” Gonzalez said. That tactic has angered restaurant operators who have rallied against the legislation. Marisol Sanchez, a second-generation McDonald’s franchise owner, has appeared in advertising opposing the 2023 bill. Sanchez said she believed SEIU was acting on its own political agenda rather than in response to worker demands.

June 29, 2023 // When the act was introduced in 2019 and 2021, I voted against it both times. Members should not be fooled by the so-called pro-worker rhetoric that has accompanied the PRO Act. You can be pro-worker without hitching your wagon to a poisonous bill that advances an ideological attack on small business owners. So next time your sink backs up or your chimney needs sweeping, think of the PRO Act and those who are pushing it.
San Jose recycling drivers allege union busting
May 10, 2023 // With a staff of less than 100 people, the family-owned business has subcontracted with local governments and prolific developers to help bring major Bay Area developments to life, from Levi’s Stadium in Santa Clara to Santana Row and San Jose Mineta International Airport’s Terminal B. Castillo is one of up to 20 drivers for the company who haul construction materials from major development sites. The drivers voted to join the Teamsters Local 853 last year after allegations of payroll issues and unsafe working conditions were not addressed. In July, the drivers will have to vote again to keep their union.

Su’s calendars also showcase her commitment to diversity, equity, and inclusion initiatives. For example, she participated in a meeting about "equity in procurement"—to ensure that government contracts go to business owners who are not white or straight—and a panel about incorporating gender and race into workplace safety.

Senate panel advances Biden Labor nominee Julie Su
April 26, 2023 // “Today’s party-line vote is another reminder that Julie Su is no Marty Walsh, who advanced in a bipartisan 18-4 vote only two years ago,” said Michael Layman, a top lobbyist at the International Franchise Association, in a statement following Wednesday’s vote. The AFL-CIO is fighting back, running ads in Arizona and D.C. backing Su’s efforts to counter wage theft in California. The ads tell viewers that workers are “tired of getting ripped off by big corporations.” The labor federation is also mobilizing its members to lobby senators. “We’re going to defend Julie against these baseless corporate special interests attacks,” AFL-CIO President Liz Shuler told reporters last week. “Every senator, especially those that haven’t yet said that they’ll vote yes, needs to be aware of how much this confirmation means to working people’s lives.”
Michigan: Wage theft package gets first committee hearing
April 14, 2023 // Under HB 4390, an independent contractor is someone who is: a) “free from control and direction of the payer,” b) “performs work that is outside the usual course of the payer’s business,” and c) “is customarily engaged in an independently established trade.” Wendy Block, Senior VP of Business Advocacy and Member Engagement for the Michigan Chamber of Commerce, compared the Michigan proposal to California’s independent contractor law. HB 4401 and HB 4406 would make it a felony punishable by up to two years in prison and or a $10,000 fine to refuse to provide that information more than once.
DOL Nominee Julie Su An Aggressive Enforcer, Inept Manager
March 8, 2023 // She was also a supporter of the state’s disastrous AB5 law, which was intended to force rideshare companies and other so-called gig economy businesses to treat their workers as regular employees rather than short-term workers. Su tweeted in 2019 that the law was “about preserving labor standards that are key to quality jobs in California.” There was little evidence the law wanted by or beneficial to rideshare drivers. Meanwhile numerous other traditional freelancing jobs were disrupted by the law, forcing state legislators to amend the bill to carve out many professions. Eventually state voters would pass Proposition 22 which exempted rideshare drivers from the law, stripping out the main thing its advocates wanted. The law contributed to California lagging behind the rest of the nation in jobs during the pandemic. Ironically, Su, should she be confirmed, will have another shot at it. The department already has a rulemaking in the works to go after employers for “worker misclassification” i.e., classifying them as freelancers rather than regular employees for whom the company must pay overtime and unemployment –a national version of AB5, with all the problems of that law.

Commentary: New California Law Will Cripple Its $20 Billion Fast-Food Industry
December 16, 2022 // California’s new law is in essence legislating away thousands of future jobs by preventing workers and employers from reaching employment agreements on their own terms. The law places failed union leadership above the interests of individuals who wish to work and business owners who wish to hire. And don’t be surprised if similar councils are formed in the future to organize workers in other industries. Unions are desperate for new recruits. After decades of losses, it appears that the only way that they can grow is by having legislators take away the freedoms that are crucial for individual prosperity and economic growth.
