October 16, 2023 // Anderson says she has worked for almost 25 years as a freelance writer, an editor or managing editor, and a photographer. She says she “started investigating” the state’s new law “and I realized that … it encompassed all professions.” “So golf caddies, videographers, photographers, nurse practitioners, whatever. Biden Bypasses Senate Confirmation in Labor’s Julie Su
October 3, 2023 // According to the GAO, she can stay in the top Labor Department post without Senate confirmation. That effectively cuts out the voters and sets a poor precedent. Now, should some federal secretary depart, the president need only appoint an “acting” replacement. According to the Government Accountability Office, that person can avoid Senate confirmation and remain on the job, regardless of their suitability for the post.

Opinion: Julie Su Keeps Failing Up, and Biden Doesn’t Care
April 10, 2023 // How in the world did Julie Su get nominated to run the federal Department of Labor? Su is a former civil rights attorney, former head of the California Department of Labor under Gov. Gavin Newsom, and head of California’s Department of Labor Standards Enforcement under former Gov. Jerry Brown. She was deputy director of the federal DOL and now is acting director as she awaits a tough Senate confirmation in the next few months. I had immediately thought that the Peter Principle might explain it. Coined by Canadian sociologist Laurence Peter in his 1968 book of the same name, it postulates that the tendency in all organizations is for “every employee to rise in the hierarchy through promotion until they reach a level of respective incompetence,” as Investopedia put it. But that surely can’t explain Su, who already reached that level in her previous employment. Investopedia also mentioned the Dilbert Principle, named after the comic strip: that big organizations promote people precisely because of their incompetence. In other words, they promote them to get them out of the way. Su was California’s top labor official and ultimately responsible for the Employment Development Department when a major scandal rocked that unemployment insurance–disbursing bureau. “California has given away at least $20 billion to criminals in the form of fraudulent unemployment benefits, state officials said Monday, confirming a number smaller than originally feared but one that still accounts for more than 11 percent of all benefits paid since the start of the pandemic,” according to a 2021 Los Angeles Times report.

While an oft-cited 2022 Gallup News report claims 71% of Americans view unions positively, most workers are disinterested in joining unions—with 58% saying they are “not interested at all.”

Conservative group launches effort to fight Biden administration workplace rules
October 28, 2022 // If implemented, the new rules could restrict independent contracting, which would force some freelancers to reclassify as employees, and broaden the definition of joint employment, making it harder to own and operate franchise businesses. Because these rules are being proposed by executive branch agencies, they do not go through rounds of debate and votes in Congress. However, under the 1946 Administrative Procedures Act, they must go through a public comment period to receive feedback before being implemented. This is where the group, Heritage Action for America, is trying to make an impact, soliciting comments from the public via a new website.

The freelance transcription profession is especially suited for seniors, so older transcritionists have been harshly affected. Teri Isveri, who runs a successful transcription company in Arizona, had to tell two of her 10-year associates that she could no longer use them once AB5 went into effect. One of them was in her 80s. “This law is crushing so many good people,” said Teri. “This woman was a lifelong Californian, veteran and elderly person who, because of AB5, now no longer has the small income she made. Opinion: Biden must reverse course and protect independent contractors
June 17, 2022 // With this new rulemaking period, the administration has a chance to turn the page on its stridently anti-independent contractor stance. Any new rules should protect the right of Americans to make a living outside of a traditional employment relationship. Under current law, there are two ways an individual can have a relationship with someone that is paying you. The first is an employee, where a person that is paying the individual has total control over how, when, and where the work is being done.
Biden Administration Continues Waging War on Freelancing
June 10, 2022 // The U.S. District Court for the Eastern District of Texas ruled the department violated the Administrative Procedure Act of 1946 by only offering a 19-day comment period on the “delayed” IC rule. Governmental agencies must allow 30-60 notice-and-comment periods. The Coalition for Workforce Innovation et al. v. Walsh decision reads like this, “Having vacated the Delay Rule, the court turns to the Withdrawal Rule. Plaintiffs claim that the Withdrawal Rule is arbitrary and capricious, in violation of the APA. Again, the court agrees.”
