Trader Joe’s employee Michael Alcorn testified before Congress in May that “after an organizer realized I wasn’t on board, they told me that they couldn’t answer any more questions and were going to devote their attention to those who would help them ‘win.’” Alcorn also said an NLRB agent told him that “it makes sense that the organizers would only talk to people who already support the union.” Under current law, that smaller number of workers can ensure a union victory if they’re the only ones who vote.

Tens of millions of independent contractors would face losing their jobs.

This decision has subjected workers to traumatizing harassment, while simultaneously barring employers from intervening. According to a report by the Institute for the American Worker, McFerran’s NLRB has used Section 7 of the National Labor Relations Act (NLRA) to excuse “racist rhetoric, sexist harassment, and vulgarity in the workplace, as long as it takes place in the context of ‘union activity.’”

    July 23, 2024 // Growers’ associations have spent millions running advertisements on Spanish radio networks and other platforms discouraging farmworkers from unionizing, the Sacramento Bee has reported. The industry has also objected to what they say is confusion in how the new law works; the labor board this month was still scheduling hearings on formal regulations to implement the law. Four of the five employers have objected to the new unions, which prompts the board to investigate and hold administrative hearings.

    July 21, 2024 // Within days, Wonderful accused the UFW of having baited the employees into signing the authorization cards under the guise of helping them apply for $600 each in federal relief for farmworkers who labored during the pandemic. The company submitted nearly 150 signed declarations from nursery workers saying they had not understood that by signing the cards they were voting to unionize.

    July 1, 2024 // Republicans should appeal directly to union members with commonsense policies. Working-class Americans are among the hardest hit by Bidenomics and its painful inflation. Republicans should reach them with policies that will reduce the cost of living and increase job opportunities. The GOP should simultaneously and forcefully oppose the union-backed demands with a message of spending restraint. Additionally, the GOP should extend the 2017 tax cuts, which are set to expire at the end of 2025 — spurring a new era of job creation and wage growth.

Speculation has focused on Georgia, Missouri, South Carolina, or even another crack at other factories in Alabama. But it’s not at all clear that the union has much support in any of these locations. It’s also unlikely that any of the potential target companies will sign a neutrality agreement, but rather will make sure workers have both sides of the story. So, while the UAW puts on a brave face and claims that Southern autoworkers will “Stand Up!” ꟷ it appears that what workers are standing up against is the UAW.

    Biden Pushes Early Renomination of Failed NLRB Chair in Effort to Deny Possible Trump Administration Control over Labor Board

    June 12, 2024 // The NLRB is composed of five members, usually three of whom are from the president’s political party and two from the opposing party. The Board uses both adjudication and rulemaking to put forward its interpretations of the NLRA, but it needs a quorum of three members to act. Currently, there are four Board members (see Board composition here). Three of the members are Democrats, while one is a Republican. The other Republican seat has been vacant since December of 2022, because President Biden chose not to nominate anyone to that vacancy for a year and a half. While agency vacancies and delays on nominations are nothing new in Washington, this one is notable and shows an unusual partisanship and dishonesty.
