    May 6, 2025 // They tried, and failed, to do just that back in 2019-20 with legislation that mirrored California’s disastrous freelance-busting ABC Test law. Independent contractors from all across New Jersey cried foul. Our elected officials ultimately decided this policy was a bad idea for the Garden State. Trenton bureaucrats are now moving to impose this ABC Test interpretation on us all anyway, through rule-making, in their final months of having power before this fall’s election.

    January 24, 2025 // Congress should consider enshrining the Trump-era definition for independent contractors, and/or consider ways to get ahead of the opposition to flexible work. The Employee Rights Act was a federal bill that, among many pro-worker provisions, sought to protect independent contractors as a counter to a national ABC Test in the now-defunct Protecting the Right to Organize Act. Portable benefits also provide a pathway for companies to provide independent contractors with workplace benefits without triggering a reclassification.

    ILA union and port owners held secret meeting on automation as new strike looms

    January 8, 2025 // A secret meeting between representatives of the International Longshoremen’s Association and the USMX port ownership group was held on Sunday to make headway on the issue of port automation that needs to be resolved by Jan. 15 to avoid a new East and Gulf Coast ports strike. A document produced from the meeting and reviewed by CNBC indicates ports willing to pair any new technology with new union jobs, but it could also introduce new risks to a deal, with added labor costs threatening terms agreed to in October for a 62% pay hike for union workers.

    US shippers avoid East Coast ports on risk of second strike

    October 31, 2024 // "Anything we expect that we need in the back half of January, we're effectively diverting to the West Coast," said Chris Peterson, CEO of Graco high chair and Crock-Pot cooker maker Newell Brands, referring to the period after the new contract negotiating deadline. Peterson said the company switched a "couple of hundred containers" of critical materials to the opposite coast to get ahead of what he expects will be a second strike lasting, at most, two weeks.

    October 11, 2024 // “The absolute control of the International Longshoremen’s Association, AFL-CIO (ILA) over hiring in the Port for over 60 years has not only led to a lack of diversity and inclusion in waterfront employment, but also to the perpetuation of criminality and corruption,” the Commission said in 2020. “For far too long, well-deserving residents of the Port’s surrounding communities were systematically denied the opportunity to work on the waterfront. Meanwhile, those who are connected to union leadership or organized crime figures are rewarded with high paying, low-show or no-work special compensation packages.”

    Some dockworkers earn more than $400,000 a year

    October 3, 2024 // More than half of 3,726 dockworkers at the Port of New York and New Jersey earned more than $150,000 in the fiscal year that ended in 2020, according to the port's regulator, the Waterfront Commission of New York Harbor. About one in five dockworkers at the port earned more than $250,000 that year. Eighteen dockworkers brought in more than $450,000 that year – more than the annual salary as the U.S. President ($400,000) and more than most U.S. workers. The real median household income for all Americans was $74,580 in 2022, according to the U.S. Census Bureau. Some dockworkers get paid even if they don't work.

    Half a century later, ILA returns to strike mode

    September 13, 2024 // The ILA is one of the least aggressive unions when it comes to coastwide strikes, especially relative to its militant West Coast counterpart: the International Longshore and Warehouse Union (ILWU), which orchestrated stoppages and slowdowns just last year to attain its desired contract. In many respects, then, the ILA is riding the wave of labor’s recent successes that were achieved through hard-line tactics. In August 2023, the Teamsters celebrated the ratification of a new agreement with UPS. A few months later, the United Auto Workers secured large pay raises and other benefits for its members after a 46-day strike against Ford, Stellantis and General Motors.

    Why Can’t U.S. Ports Get Automated?

    August 21, 2023 // But U.S. officials say the country’s ports face big hurdles in adding robots, including space constraints, the tough economics of getting a return on hefty investments and, most prominently, fierce opposition from organized labor. The labor concerns at ports are part of the questions over automation arising in the broader industrial economy as businesses look to use more robotics in a range of logistics operations, from warehouse work to self-driving trucks. Wrangling over automation was one reason recent contract talks between West Coast dockworkers and their employers dragged on for more than a year before the two sides reached a tentative agreement in June. The hot-button issue is now shifting to the ports on the East Coast and Gulf Coast. The leader of the union that represents East Coast and Gulf Coast dockworkers, the International Longshoremen’s Association, told a convention in July he intends to build an international coalition of maritime unions to stop automation in maritime operations. “There’s going to be an explosion and the ILA and the dockers around the world are going to light the fuse,” ILA President Harold Daggett said. “It’s time we put companies out of business that push automation.”

    August 17, 2023 // The commission’s death was a triumph for Gov. Phil Murphy, whose administration took the fight to the U.S. Supreme Court, and his allies in the International Longshoremen’s Association, the maritime labor union that has controlled hiring at the port for decades. In late July, Murphy traveled to the union’s international convention in Hollywood, Fl. to celebrate the victory and salute the man he calls a “dear friend” and “partner in growing the New Jersey economy,” ILA President Harold J. Daggett. “I am happy to report that as of last Monday, the commission has been officially dissolved,” said Murphy, addressing more than 1,000 cheering union members assembled in the grand ballroom of The Diplomat Beach Resort. “Now we can finally begin to turn the page, and together, I look forward to starting a new chapter at our ports.” Murphy’s speech came a day after a profanity-laced address by Daggett, who promised a “painful” comeuppance for union foes and companies that would attempt to replace workers with automation. He vowed to cripple port commerce next year if the union’s contract demands aren’t met. “Mark my words! There’s going to be an explosion,” Daggett said. “Someone must take the bull by the horns, and that’s me… Don’t f–k with the maritime unions around the world. We will shut you down!”
