Restaurant Minimum Wage Hurting Businesses and the Workers Proponents Seek to Help
January 10, 2025 // For fast food operators, it’s not just this latest minimum wage increase. Since 2013, their minimum wages have increased from $8 to $20, which is 2.5 times. It’s unsurprising that they’re slashing jobs, cutting hours and raising prices. This also coincides with a major turn towards automation. Of course, automation is driven by many factors, not just increased labor costs – but they certainly don’t help.

October 10, 2024 // The National Labor Relations Act (NLRA) protects such meetings, and the Supreme Court has repeatedly recognized their legality and importance in helping employees gather information on potential union representation. As a result, even if the referendum were to pass, a court would likely find it unlawful. Alaska’s referendum also increases the state’s minimum wage to $15 per hour by 2027 and provides at least 40 hours of paid sick leave to many workers.
“Warehouse Worker Protection Act” Reintroduced with Bipartisan Support
October 2, 2024 // The bill imposes restrictions on employers’ use of productivity quotas to measure workers’ performance or output and includes substantial notice requirements to workers on the use of such quotas, discipline for failing to meet the quotas, and workers’ rights under the act, among other things. It mandates breaks for covered workers and recordkeeping obligations for employers. The WWPA also requires the Occupational Safety and Health Administration (OSHA) to issue two new rulemakings and creates a new category of unfair labor practices under the National Labor Relations Act (NLRA). It also expands the federal bureaucracy by creating a Quota Task Force as well as the Fairness and Transparency Office within the Department of Labor. This legislation is a thinly-veiled attack on large companies like Amazon that the Democratic Party and labor organizations do not support. The original sponsors of the WWPA were Senators Markey, Bob Casey (D-PA), and Tina Smith (D-MN). The cosponsors now include Senators Richard Blumenthal (D-CT), Sherrod Brown (D-OH), Laphonza Butler (D-CA), Kirsten Gillibrand (D-NY), Hawley, Alex Padilla (D-CA), Bernie Sanders (I-VT), Elizabeth Warren (D-MA), and Peter Welch (D-VT).

August 17, 2024 // Senator Bernie Sanders’ recently released Amazon Investigation Interim Report is an example of such an effort that put America’s small business community in the crossfire. I can't help but think that the report was created to serve a personal agenda against the nation’s largest online marketplace. It relied on outdated data to draw misleading conclusions that Amazon is a uniquely dangerous workplace and sets an inappropriate and extreme precedent rife with questionable methodology and bias. Opinion: Your freelance job is in jeopardy (Radio)
April 18, 2024 // The DOL issued a rule creating a very strict and confusing definition of a 1099 worker which will certainly have a chilling effect on the entrepreneurial environment and the opportunities available to freelancers. A similar bill was passed in California (AB5) and it devastated small businesses and freelancers. Pacific Legal Foundation is now representing Kim and other plaintiffs in a lawsuit against the DOL. I want to thank Congressman Tom Kean Jr. for sponsoring action on behalf of the New Jersey delegation to push back against this intrusive and egregious assault on independent contractors.

Everything You Need to Know About the Department of Labor Independent Contractor Rule
March 12, 2024 // The DOL does not provide an analysis of how many independent contractors will actually become employees. Let’s say a company is contracting with 100 photographers, all of whom are affected by this rule: how many of those photographers will become employees? It’s clearly not all 100 of them. To unpack the potential benefits (and costs) on workers, we need some analysis into how many of those 100 freelance photographers would become employees. Another consideration for the benefits side of the equation is whether most independent contractors are currently working with small businesses or larger ones. This matters because, as I point out in a previous post, many small businesses do not provide healthcare insurance, retirement benefits, or maternity benefits to their employees. This means that the “benefits” differences between an independent contractor and an employee at a small business are smaller than expected.

February 20, 2024 // The rule is slated to take effect on March 10. U.S. Sen. Bill Cassidy (R-La.) and Rep. Kevin Kiley (R-Calif.) have both declared they will use the Congressional Review Act to have this rule rescinded. Previous legislation has been tendered in support of small businesses and the self-employed. The “Fight for Freelancers” group of female writers and editors has filed a lawsuit challenging this rule, which serves to appease Big Labor in the same manner as AB5.
Switching from tipped to minimum wage would be ‘catastrophic,’ restauranter says
February 7, 2024 // While some are advocating for tipped workers to get the minimum wage with tips on top, a legislator who also owns restaurants says such a move would be devastating to the economy. Advocates from the group One Fair Wage organized a rally outside of the Illinois statehouse Tuesday as legislators were returning.
