The legislative package is supported by independent worker organizations like Flex Association, the Institute for the American Worker and the National Retail Federation, to name a few. “The Unlocking Benefits for Independent Workers Act is an important step toward addressing some of the federal legal hurdles that complicate efforts to connect independent contractors with portable benefits while ensuring that the millions of Americans who choose to earn on their own terms can continue doing so without risking the independence and flexibility they value. Ed Markey (D-Mass.) and Tina Smith (D-Minn.) rolled out the Warehouse Worker Protection Act with Teamsters President Sean O’Brien, legislation that enacts a host of new government mandates on workplaces. Like the failed “Protecting the Right to Organize Act,” its end goal is to force more American workers into unions. The bill targets companies that use so-called “quotas,” framing attempts by employers to evaluate employee performance as inherently anti-worker. Despite the scary narratives progressives peddle, tracking employee performance is a common business practice, and employers use these metrics to ensure employees are operating safely and efficiently.
Ranking Member Cassidy, Kiley Introduce CRA to Overturn New Biden Regulation Threatening 27 Million American Independent Contractors
March 6, 2024 // Independent contractors, or freelancers, make their own hours to fit their schedule and decide where and how they want to work. The Biden administration rule attempts to restrict the ability of American workers to be an independent contractor and take advantage of the flexibility it provides. The rule creates a non-exhaustive, six-factor litmus test for unelected bureaucrats to interpret and decide who is and who is not classified as an independent contractor. It also casts as large a net as possible and gives less legal certainty to independent contractors impacted by the regulation. “The Biden administration’s priority should not be to do whatever makes it easier to forcibly and coercively unionize workers. It should be to increase individual freedom and opportunity,” said Dr. Cassidy. “This new Biden rule does the opposite, jeopardizing 27 million workers’ ability to make their own hours and make a living without being pressured into joining a union.”
‘Independent Contractor’ Rule Latest Dumpster Fire Exported From California
January 31, 2024 // One of those infamous policies and the havoc it’s bound to wreak has gone national, thanks to labor department rules issued by the Biden administration. A 339-page Department of Labor rule – you can always count on the federal government to keep it pithy – would make it much harder to be an independent contractor or freelance worker in America. Created to replace a simpler Trump-era rule, it’s modeled on AB5, a disastrous 2019 California law that made independent contracting and freelance work so hard to do that it effectively outlawed it in the Golden State.
Labor board drops UAW complaint against Sen. Tim Scott
November 5, 2023 // The complaint centered on comments Scott made at a campaign event where he endorsed firing striking workers, which is against the law. “I think Ronald Reagan gave us a great example when federal employees decided they were going to strike,” Scott said at an Iowa campaign event. “He said, ‘You strike, you’re fired.’ Simple concept to me, to the extent that we can use that once again.” The union said Scott was “engaging in unfair labor practices.” Scott denounced the complaint when it was filed, saying UAW was attempting to “threaten” him and “shut me up.”
