The ability to say who they want to be represented by, how they want their money spent, and how they want to work. And I know we talked about it briefly with the ERA, but the ability for an independent contractor to work for themselves, not be considered an employee, small business owner, to own a franchise, all those things are core to what the flexibility and the entrepreneurship of the modern worker, and those are the concepts that are embraced, you know, not just on the union end of the Employee Rights Act, but on the innovation and entrepreneurial spirit and pro worker end of the ERA.

    October 28, 2024 // But the union hasn’t been what many of our co-workers expected. The officers basically selected themselves. They then delayed negotiations with Trader Joe’s while forfeiting our annual bonus retirement contribution. Amid growing discontent in the store, the two of us attended a bargaining session in February 2023, which the union president invited all crew members to join. We were shocked at what we saw. We thought the union would focus on things that matter, like wages and benefits. Instead, union representatives negotiated over things like “pronoun pins,” which the company already provides. They demanded that Trader Joe’s cover abortion and “gender-affirming care.” The company’s response: The health plan already covers that.

    US labor watchdog pressures Trader Joe’s to bargain with New York union

    September 26, 2024 // The general counsel of the US’s top labor watchdog is seeking an order demanding that Trader Joe’s recognize and bargain with the union, Trader Joe’s United, amid allegations that employees were threatened and disparaged from unionizing. Under a framework introduced by the National Labor Relations Board (NLRB) last year, employers can be ordered to bargain with a union if they commit unfair labor practices that would set aside the results of a union ballot.

    Trader Joe’s workers look to decertify union at first unionized store

    August 16, 2024 // Workers at a unionized Trader Joe’s location in Hadley, Massachusetts, have petitioned the National Labor Relations Board to hold a vote to determine whether to remove Trader Joe’s United from its role representing employees at the store, according to a Monday announcement from the National Right to Work Legal Defense Foundation, which is assisting the workers. The petition includes signatures from “well over” 30% of workers at the store — above the threshold the NLRB requires to trigger a decertification election — the foundation said.

    Hadley, MA, Trader Joe’s Employees Seek Vote to Remove SEIU-Backed Union Officials from Store

    August 13, 2024 // Employees at the Hadley, MA, location of grocery chain Trader Joe’s have submitted a petition seeking a workplace election to remove the Trader Joe’s United union, an affiliate of the large Service Employees International Union (SEIU). Trader Joe’s employee Les Stratford submitted the petition to National Labor Relations Board (NLRB) Region 1 in Boston with free legal aid from National Right to Work Foundation staff attorneys.

    Trader Joe’s in Chicago files to unionize

    April 11, 2024 // The Tribune reports that the Trader Joe’s filed for a union election on Monday, and needs 140 “yes” votes in order to establish the union. The workers there are not affiliated with an established union and instead are organizing independently under the name Trader Joe’s United. One worker at the store told the Tribune that she makes $22.50 an hour and receives 75-cent raises twice a year. Trader Joe’s spokesperson Nakia Rohde told the Tribune that its workers receive annual raises of approximately 7%.

    NLRB seeks to force Trader Joe’s to reopen New York wine store

    January 25, 2024 // The NLRB said its general counsel is seeking remedies including compelling Trader Joe’s to reopen the store, which was located in New York City’s Union Square neighborhood and closed in 2022, and “make-whole relief” for its workers. The NLRB intends to encourage the union and Trader Joe’s to reach a settlement and has scheduled a hearing before an administrative law judge starting on May 7. Either party could appeal the judge’s decision to the board and ultimately to a federal appeals court. The UFCW hailed the NLRB’s decision to file the complaint as a victory for Trader Joe’s workers in their effort to gain leverage against Trader Joe’s.

    September 19, 2023 // A current unionization campaign shows the threat. After losing an April election at a New York City store, the Trader Joe’s United union claimed that management tainted the election. How? By informing their employees about the company’s views on unionization and putting limits on posting union flyers on bulletin boards and break-room tables. The union wants the NLRB to force Trader Joe’s to bargain, yet regardless of whether that happens, unions will take advantage of Cemex and launch a new wave of organizing campaigns, even ones they’d normally lose. The Cemex decision should be seen for what it really is: A blatant handout to unions — and a blatant assault on workers and job creators. The best answer to the NLRB ruling is the Employee Rights Act, which, among other things, would permanently ban card check and protect workers’ right to a secret ballot. Workers would get a second election instead of being forced into an unwanted union. Businesses and workers are also likely to challenge the NLRB in federal court. They deserve to succeed. If unions want to represent workers, they should win a vote in a free and fair election.

    Why you should care about the Cemex decision

    September 13, 2023 // Up until the recent Cemex decision, employers could deny recognition of these authorization cards. In such cases, the union would need to petition the NLRB for a secret ballot election. However, under the new standard set by Cemex, the responsibility to petition for a secret ballot election now rests with the employer (with a suggested 14-day time limit). If the employer fails to do so, the union will be certified based on the original card check. Additionally, if the NLRB determines that the employer engaged in unfair labor practices during the election period, it can reject the election petition and certify the union based on card check. So, what does all this mean? It’s now easier for private sector unions to use card check to gain a foothold in workplaces, potentially leading to an increase in coercive practices and intimidation.
