    ‘Battle royale’: Tesla and anti-union Musk make enticing targets for UAW’s next push

Absolutely, I would go,” said John Jake Kincaid, a Stellantis employee in Michigan. “Show them our strength.” Still, fighting for a contract at companies with established relationships with union workers is a far different effort than starting from scratch. Several workers who were key to Tesla’s earlier union effort are no longer at the company. The Fremont plant’s history with the UAW predates the electric vehicle maker. For about 25 years, Toyota and GM operated the facility together in an unusual joint venture. It was a union shop. In 2009, GM pulled out of the partnership as part of its bankruptcy proceedings and in 2010 Toyota shut the operation down, throwing 4,700 people out of work. A month later, Tesla bought the sprawling 5.3 million square foot factory; the union didn’t come with the purchase.

The ongoing strike by film actors and writers has also been a factor, spotlighting the power of workers uniting. Writers walked off the job in May, followed by actors in July. Both unions are asking for better pay, and guarantees that AI will not steal their jobs and income, among other demands. The strikes have halted production on many studio films and television series.

    Writers Guild Suggests Studios Should Split From Streamers in Latest Update on AMPTP Standoff

    September 11, 2023 // In its latest strike-era update to members, the Writers Guild of America is suggesting that studio member companies of the Alliance of Motion Picture and Television Producers break off from the organization and negotiate individual deals with the union. As negotiations appear to be remaining at a standstill, the WGA’s negotiating committee told members in a Friday update that behind-the-scenes conversations with individual legacy studio executives amid the strike have shown a “desire and willingness to negotiate an agreement that adequately addresses writers’ issues.”

    August 30, 2023 // Wanted or not, the spotlight has found her. Many union members blame her for the negotiating logjam that has brought almost all movie and television production in Hollywood to a halt. Partly because of her woman-of-mystery persona and partly because she’s an easy target, Ms. Lombardini has become an avatar for the grievances of tens of thousands of striking workers. “Carol can go kick rocks,” Caroline Renard, a striking writer, said this month on X, the social media platform formerly known as Twitter. With her public personality absent, actors and writers have invented one. In May, someone started a parody account on X that has portrayed Ms. Lombardini as a crass tyrant declaring, “I’m a goddess of chaos!” (Yes, she has seen it, an associate said. No, she is not amused.) Another group of screenwriters have mocked Ms. Lombardini online as a fuddy-duddy who hangs out at chain restaurants, the taunt being that no Hollywood person would be caught dead in one. (Her office is near a Cheesecake Factory in suburban Los Angeles.)

    August 28, 2023 // Many baristas say one Starbucks strategy in particular has discouraged workers from unionizing. In May 2022, Schultz announced that Starbucks would give certain raises and benefits to workers at its more than 9,000 non-union stores, but not offer those raises and benefits to its unionized workers. Starbucks insists it would be illegal to impose any raises or benefits on its unionized stores without first negotiating about them, but the NLRB’s general counsel asserts that this policy constitutes unlawful discrimination against Starbucks’ unionized workers. Under this policy, Starbucks has given its non-union workers, but not its unionized ones, a more relaxed dress code, increased training, faster sick leave accrual and, most important, credit card tipping. (Workers at the first few Starbucks stores to unionize had asked early on for credit card tipping.)

The 11,000 members of the Writers Guild of America, by contrast, have been on strike since May. Last month, the actors union joined them on the picket line. It’s the first time the two have jointly struck the studios since 1960 and the most closely watched labor action of the year. Almost 3 in 4 Americans say they’re aware of the strike, according to a Los Angeles Times poll released Aug. 3. Among the issues are revenues from web streaming and the use of AI to generate actors’ likenesses.

    US labor board says work rules cannot hamper unionizing

    August 4, 2023 // Wednesday's ruling stems from a union's challenge to Stericycle Inc's policies barring worker conduct that could harm the company's reputation or create conflicts of interest. The labor board did not rule on the merits of the case but sent it back to an administrative judge to apply the new standard. The board's Democratic majority said employers can rebut the presumption that a rule is unlawful by proving to the NLRB that it "advances a legitimate and substantial interest" that cannot be addressed with a narrower policy. NLRB Member Marvin Kaplan, a Trump appointee, in a dissenting opinion said that standard will be virtually impossible for many employers to meet. He added that his colleagues had failed to balance workers' labor rights with businesses' ability to adopt reasonable rules.

    ESG Is a Front for Labor

    July 24, 2023 // House Republicans have declared July “ESG month,” planning hearings and bills to push back against politicized environmental, social, and governance investing. Yet so far, lawmakers have almost exclusively focused on environmental issues. Republicans should also pay attention to the “S” in ESG, which labor unions are using to advance their agenda at the expense of workers, their own members, and even taxpayers — a problem that President Biden has significantly worsened. The 2023 proxy season, which started in January and ended in June, shows the union campaign in action. Union funds and their allies, such as the New York City Employees’ Retirement System and like-minded investment managers, introduced many ESG-focused shareholder proposals designed to accelerate unionization. Consider Apple, which was targeted by five New York City pension funds, multiple investment managers, and the SEIU Master Trust Pension Plan, among others.

    Focus organizing drives on workers without college degrees, US unions told

    May 8, 2023 // n contrast, unionization hasn’t taken off nearly as rapidly at many blue-collar, lower-paid workplaces. No other Chipotle restaurant has unionized since workers in Lansing, Michigan, voted last August to make theirs the nation’s first unionized Chipotle. Only one Amazon warehouse is unionized in the US, just two Apple stores and four Trader Joe’s. Those companies have mounted fierce anti-union counterattacks to slow and they hope stop the spread. Chris Rosell, the Teamsters’ organizing director, says one reason unionization of blue-collar workers often doesn’t catch fire is that it’s frequently easier for anti-union consultants to scare and deter those workers. “Blue-collar workers often aren’t as educated about this union-busting stuff,” he said. “They could be more susceptible to these kinds of tactics.” Rosell said the Teamsters often run elaborate campaigns that seek to inoculate workers from the pressures and propaganda from anti-union consultants. He said the Teamsters’ president, Sean O’Brien, hopes to double the union’s membership and focus organizing on such area trucking, warehouses and sanitation work. Erica Smiley, executive director of Jobs with Justice, a labor rights group, says it’s often harder to unionize blue-collar workers because they tend to have less economic security than educated workers and have greater fear of what will happen to them if they’re retaliated against, perhaps getting fired, for seeking to unionize.
