    Despite Biden’s Efforts to Empower Unions, Membership Rates and Wage Advantages Fall to All-Time Lows

    January 24, 2024 // So, why have unionization rates and union wages been falling despite significant union-organizing efforts at places such as Starbucks, Amazon and Trader Joe’s, as well as President Joe Biden’s “whole of government” approach toward increasing unionization? Primarily, it’s because unions aren’t providing things that workers want or need. Many workers don’t like unions spending their dues on politics instead of representation, their not infrequent deception and coercion to gain support or their rigid structures that impede flexibility and prohibit performance-based pay. Meanwhile, by engaging directly with their employers, workers have been able to achieve stronger wage gains (albeit entirely erased by inflation), increased workplace flexibility, expanded benefits (such as paid family leave) and a multitude of educational opportunities.

    COMMENTARY: Good news: 2023 won’t mark a union revival

    January 3, 2024 // The decline of union membership has been remarkably steady over the last four decades. Since 2000, the year-to-year change in the unionization rate has been positive only six times, and those small gains have quickly been reversed. Moreover, the latest data show that unionization is increasingly concentrated in the government sector, especially local services such as K-12 education and public safety. Only 6% of private sector workers are union members.

    Federal Charge: East Bay-Area Construction Materials Worker Illegally Fired for Refusing to Join Union

    October 17, 2023 // The charges state IUOE bosses illegally demanded she join the union as a condition of keeping her job and instigated her firing by CTS when she refused to join. Additionally, Le’s charges maintain that company and union officials violated the law by deducting union dues directly from her paycheck without her permission. Le, a firestop inspector, filed the charges at National Labor Relations Board (NLRB) Region 32 in Oakland, CA, with free legal aid from the National Right to Work Legal Defense Foundation. She notes in her charges that IUOE officials not only failed to inform her of her right to abstain from union membership, but also never notified her of her right to pay a reduced amount of union dues as a nonmember. Because California lacks Right to Work protections for its private sector workers, Le and her coworkers can be forced to pay some dues to the union as a condition of keeping their jobs, even if they’ve abstained from formal union membership. However, as per the Foundation-won CWA v. Beck Supreme Court decision, even in non-Right to Work states union officials can’t force nonmember employees to pay for union expenses beyond what the union claims goes to bargaining, such as union politics

    Record number of public employees abandoned their unions this quarter

    October 10, 2023 // “I couldn’t be more proud of the work the Freedom Foundation is doing to help people keep more of their hard-earned paychecks and stop funding distant, bloated, ideological government unions," Freedom Foundation CEO Aaron Withe said in a statement. "These aren’t merely statistics; they represent thousands of public employees exercising their constitutional right not to be forced to fund union activity as a condition of employment. “It’s gratifying to know that as the cost of everyday goods and services continues to rise, our work is directly helping people put more gas in their car or food on their table rather than line the pockets of union bosses who back the very policies causing many of the country’s economic hardships,” Withe said. Public unions nationwide have about 7 million members and subsequently collect over $5 billion annually in dues. As the average annual rate of dues is $1,000, the Freedom Foundation estimates that $13 million was saved with the third quarter opt-outs alone.

    September 28, 2023 // If union officials actually want to protect UAW jobs and improve workers’ compensation, then they have to want the Big Three American automakers to succeed and to grow. Considering that U.S. auto production is less than half of what it was two decades ago, success is likely going to require that the UAW work alongside—rather than against—U.S. automakers to help them become more competitive. To the extent that involves lobbying policymakers, the focus should be on getting the government out of the business of picking winners and losers by its subsidizing of more expensive electric vehicles that require 40% less labor while also seeking to ban gas-powered vehicles that Americans still overwhelmingly desire. And if unions across America want to increase their membership, they should appeal directly to workers by offering things they value instead of using their dues to get politicians to go against their interests by doing things like attacking secret ballot union elections, restricting employers’ ability to share important information with workers before union elections, and establishing a pathway to force an employer to bargain with a union even if workers don’t want to be represented by it.

    September 5, 2023 // "Yet, instead of adapting and finding ways to still provide value to workers, unions have maintained strictly seniority-based compensation structures and rigid workplace rules that reduce workers’ productivity, pay, and flexibility. That ends up hurting workers who desire autonomy and flexibility. For example, young workers who are parents typically lack the seniority needed to choose the hours they want. And workers who want to put in extra effort to earn a pay raise have little incentive to do so because most union contracts prohibit employers from giving employees performance-based pay raises or bonuses that exceed the union-negotiated pay scales."

    August 14, 2023 // Members of AFSCME Council 31 eagerly voted in local union meetings over the past two weeks to ratify the contract, which negotiators had tentatively agreed to on July 1. And who could blame them? The contract also includes a $1,200 “stipend” paid to every worker merely for ratifying the contract. Pritzker, a Democrat, included these bonuses in his last contract negotiation in 2019, ostensibly to compensate workers for the financial “hardship” of being state employees under his Republican predecessor, Bruce Rauner. Predictably, such payoffs have now become standard operating procedure. The governor celebrated his and AFSCME’s windfall by tweeting out, “Illinois is a pro-worker state through and through.” The pronouncement was eerily reminiscent of Biden’s one-time campaign promise to become the “most pro-union president you ever saw.”

    August 10, 2023 // This year’s bargaining sessions tell the story. The mere threat of a strike won longshoremen, UPS drivers, and other blue-collar workers big pay raises. The 11,000 members of the Writers Guild of America, by contrast, have been on strike since May. Last month, the actors union joined them on the picket line. It’s the first time the two have jointly struck the studios since 1960 and the most closely watched labor action of the year. Almost 3 in 4 Americans say they’re aware of the strike, according to a Los Angeles Times poll released Aug. 3. Among the issues are revenues from web streaming and the use of AI to generate actors’ likenesses.

    August 4, 2023 // Despite union legal tactics delaying the certification of an NLRB decertification election, Masami Foods workers are free of unwanted union The case is an example of how the NLRB’s union decertification process is prone to union boss-created roadblocks. Foundation-backed reforms the NLRB adopted in 2020 made it somewhat easier for workers to remove unwanted union officials. However, the Biden NLRB is attempting to roll back these protections and make it much harder to decertify a union. For example, the 2020 reforms blocked union officials from resubmitting overlapping charges, which often contain unverified and unrelated allegations of employer actions and delay the process further. Had these reforms not been in place, the three-month delay for these workers could have been extended much longer, possibly effectively indefinitely.
